Garcinia Cambogia class action settlement

Private Label Nutraceuticals LLC (doing business as MaritzMayer Laboratories) has agreed to settle a class action lawsuit alleging it falsely advertised or misrepresented that some of its Garcinia Cambogia supplements are effective weight loss supplements.

If you purchased Garcinia Cambogia 1300 and/or Garcinia Cambogia 75 in the United States between Nov. 26, 2010 and Jan. 29, 2016, you may be entitled to a refund from the class action settlement.

The Garcinia Cambogia class action lawsuit was filed by plaintiff Stephen Colucci, who alleges that the Garcinia Cambogia 1300 and Garcinia Cambogia 75 products manufactured, marketed, and sold by Private Label Nutraceuticals d/b/a/ MaritzMayer Laboratories were deceptively labeled.

According to the Garcinia Cambogia class action lawsuit, the defendant marketed the products with the following claims: “Supports Appetite Control” and “Inhibits Fat Production.”

“In reality, the Products’ ingredients have never been scientifically substantiated as being able to support appetite control or inhibit fat production, and certainly not to the extent claimed by Defendant,” Calucci alleges in the second amended Garcinia Cambogia class action lawsuit.

“Defendants’ statements about the Products’ efficacy are false and misleading, and Defendant can point to no scientific evidence to support its unfounded claims,” the Garcinia Cambogia class action lawsuit continues. “In reality, the scientific studies and meta-analyses of available studies regarding the ingredients in the Products, show results contrary to Defendants’ claims.”

MaritzMayer stands by its advertising and denies any wrongdoing. However, the company has agreed to settle the Garcinia Cambogia class action lawsuit to avoid the expense, inconvenience and risk associated with ongoing litigation.

In addition to offering refunds to Class Members who purchased the Garcinia Cambogia products, MaritzMayer has also agreed to modify the outer packaging on the products to include the following disclaimer: “Caloric restriction and exercise required to obtain desired results. Results may vary.”

The Garcinia Cambogia class action settlement was preliminarily approved on Nov. 5, 2015.

UPDATE: On May 9, 2016, Top Class Actions readers who submitted valid claims for the MaritzMayer settlement began receiving checks worth as much as $19.99.

Who’s Eligible

Class Members of the Garcinia Cambogia settlement include all U.S. residents who purchased Garcinia Cambogia 1300 and/or Garcinia Cambogia 75 in the United States for personal use between Nov. 26, 2010 and Jan. 29, 2016.

To be eligible for benefits from this class action settlement, Class Members must have lived in the United States at the time of purchase.

Potential Award

Full refund of the price of five products (with proof of purchase), or up to $9 without proof of purchase.

Class Members who submit proof of purchase with their Claim Forms will be entitled to a full refund of the amount shown on the receipt for up to five purchases of the Garcinia Cambogia products.

Class Members who do not submit proof of purchase with their Claim Forms may submit a claim for $3 per products, with a $9 cap per household.

Proof of Purchase

No proof of purchase is required; however, Class Members who do not provide proof of purchase will be limited to a maximum refund of $9 per household.

Class Members who submit proof of purchase with their Claim Forms will be entitled to a full refund of the purchase price shown on the receipt for up to five purchases of the Garcinia Cambogia products.

    Apparently the claim form, at 176% font, cannot be completed on-line ? I am too damn tired to re-size, print on both sides, copy ,on my knees fish out years of receipts stapled to credit card statements, separate & copy them, find an envelope and stuff them inside, affix postage, then wobble down to the USPS & back on ice and probably in the upcoming blizzard stumbling about on my cane w/my service dogg, Snoop Dogg, all for $9 in the probably event that I sent in the wrong receipts. Yep, like everyone else, I never lost a single pound on these pills and Im glad there is a Class Action suit. Its ironic in my case bec. I just tossed out about 300 pills emptying out at least 10 bottles of GC so that I could free up cabinet space and be rid of the stupid things. However, I have lost around 25 lbs since June using Qsymia, a prescription only, expensive medication but worth every dollar because it works. Well, until I find out it probably doing awful things to people long term….but so far Ive had no side effects.

    I bought this and the liquid they sold on tv 3 bottles for 109.00 didn’t work .. Stupid me wish they had a suite on that one too.

    I cant file electronically. Thats a shame, I bought some of these. I didnt keep proof of purchase, so Im not printing that out and mailing it for 9 bucks. Pass….
