A $2.25 million settlement has been proposed in a class action lawsuit alleging that JPMorgan Chase violated federal law when it used “robocalling” as a part of a marketing scheme to contact consumers without their permission.

Lead plaintiffs, Tomeka Barrow and Anthony Diaz, alleged in their class action lawsuit that JPMorgan Chase violated the Telephone Consumer Protection Act by using a robocaller to contact hundreds of thousands of individuals to attempt to collect on mortgage and home equity line of credit accounts.

The plaintiffs say that they asked JPMorgan Chase to stop the calls, but to no avail. The class action lawsuit alleges that more than 200,000 individuals received robocalls from Chase.

The Telephone Consumer Protection Act (TCPA) was enacted to protect consumers from annoying and harassing calls from companies. The law prohibits companies from using automatic telephone dialing systems or prerecorded or artificial voices, i.e. “robocalls,” to contact individuals without permission.

Companies can be hit with steep fines under the TCPA of $500 per violation or up to $1,500 per violation if it is proven the calls were placed willfully.

JPMorgan Chase denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the cost and uncertainty of ongoing litigation.

The company will pay cash awards to Class Members and has also agreed to disburse any unused settlement funds to two nonprofits, Prosperity Now and New Media Rights.

Class Members who would like to opt out of or object to the Chase robocalls class action settlement must do so no later than Aug. 13, 2018.

Who’s Eligible

Class Members include anyone who received calls from JPMorgan Chase, or “any affiliate or agent acting on its behalf, to their cellular telephone through the use of an automatic telephone dialing system or a prerecorded or artificial voice on between April 20, 2012, through March 16, 2018, regarding a mortgage or home equity line of credit account despite orally requesting, prior to the call, not to be called.”

Potential Award

$5 to $101 depending on how many Class Members submit claims.

      There is a 30 day period in which appeals can be filed. No appeals as of today, which is good news. It is not known how quickly claims will be paid. It can take several months for the settlement administrator to review and process claims.

    It was in my spam also but I caught it in time to submit it – You might be able to still send it if you had filed the claim since payments have not been sent out – email them they got back to me the same day.

    this is notated in the final hearing agreement, i might be wrong idk but i think this means each person gets $5,000 each ?

    How are we supposed to know if they’ve called? I get so many spam calls can’t keep track. Do they have a place where you can enter your phone number and verify?
