A settlement has been preliminarily approved between York International and Johnson Controls Inc. (JCI) and a group of consumers who allege the companies sold defective copper evaporator coils and copper condenser coils.

An evaporator coil is a part of an air conditioning system or heat pump system and is inside your house. A condenser coil is a part of a condensing unit and is outside your house.

Three plaintiffs filed the lawsuit on June 5, 2015 (two additional named plaintiffs joined the lawsuit later) claiming the defendants manufactured and sold air conditioning systems and heat pump systems, including air handlers and packaged HVAC units, containing defective copper evaporator coils and copper condenser coils that corrode and leak refrigerant.

The class action lawsuit alleged that the copper coils are made using uncoated copper tubing and are susceptible to corrosion. Specifically, a kind of corrosion called formicary corrosion that causes microscopic tunnels to form within the copper tubing and causes the coils to leak refrigerant.

The plaintiffs contend that JCI knew or should have known about the defective copper coils and along with informing customers about the defect, should have replaced the defective copper coils rather than simply replace the refrigerant in the unit when the copper coils leaked.

Under the terms of the proposed settlement deal, JCI and York have agreed to pay eligible Class Members who experienced one failure of a Copper Coil while the Copper Coil was covered by the original limited five-year warranty or extended 10-year warranty and incurred any out-of-pocket expenses as a result of that failure, a $75 Service Rebate Certificate valid for one year from the date it is issued, to be used as payment for maintenance on their HVAC system performed by an authorized JCI dealer.

Class Members who experienced two or more failures of a Copper Coil while the Copper Coil was covered by the original limited five-year warranty or extended 10-year warranty, and paid for labor, refrigerant, or parts associated with the replacement of their Copper Coils, will receive a check as reimbursement for their out-of-pocket expenses of up to $550 for each replacement (but no more than $1,100 for all replacements).

Those who experienced a first failure of a Copper Coil while the Copper Coil was covered by the original limited five-year warranty or extended 10-year warranty, will receive at no cost a new Aluminum Replacement Coil, plus a $75 Service Rebate Certificate valid for one year from the date it is issued, to help defray the cost of the installation of the Aluminum Replacement Coil or to be used as payment for maintenance on their HVAC system performed by an authorized JCI dealer after the date the Service Rebate Certificate is issued.

All settlement Class Members who experience two or more failures of their Copper Coil while it is covered by the original limited five-year warranty or extended 10-year warranty, if at least one of the failures occurs after the settlement approval date, and paid for labor, refrigerant, or parts associated with the replacement of their Copper Coils, will receive at no cost a new Aluminum Replacement Coil, plus a check as reimbursement for their out-of-pocket expenses of up to $550 for each replacement (but no more than $1,100 for all replacements).

The new Aluminum Replacement Coil will be provided through any authorized JCI dealer.

The settlement also provides $1 million in attorneys’ fees, $25,000 in court costs, and a $2,500 service award for each Class Representative.

JCI denies all of the claims in the lawsuit, but has agreed to the settlement in order to avoid the cost and uncertainty of litigation.

Class Members who wish to exclude themselves or object to the terms of the settlement must do so by Mar. 7, 2017.

    1. Shirley says:

They are not responding to my emails anymore. I have emailed them 3 times since the 17th.

  2. jamie says:

Ive heard nothing. I reached out to find out from admin and they said they were asking for additional documents from some claims. i have received no communication and wanted to see if i needed to resend and nothing back from them so far.

    1. Shirley says:

I received an email on the 18th of September saying that they were prepared to distribute funds. But have not heard anything since. Emailed them yesterday for an update, no response.

      1. sylvia butelle says:

Just took a look at the case on pacer and if i read it correctly, they havent even filed a motion to distribute funds yet. So we know distribution wont occur within the next 30 days. I did notice a cpl claimants wrote directly to the court to complain about the amount of time the claim administrator is taking to process claims and not responding to claimants inquiries. Its good to be proactive but from what i know about settlements, claims administrators take direction from the case attorneys. So address the attorneys as well.

  3. sylvia butelle says:

    Update on distribution anyone?

  4. jamie says:

I have emailed and asked status of this and i keep getting answer that payments will be made very soon within first quarter of this year. Has anyone received anything? i turned in all documentation and proof yet haven’t heard anything new.

    1. jennette passadonno says:

Were almost at the end of the 2nd Qtr but i got a response from settlmnt admin back on apr 24 saying “payments will be made on a rolling basis in the coming weeks.” That was almost 8 weeks ago.

      1. jamie says:

Me too and it has been a long time now already.. what is going on here

  5. Gary Roberts says:

We purchased a new built home, 1101B Petway Avenue, Nashville, TN in 2014, which we use as a rental. Two York air conditioning units were installed by Universal Heating & Cooling, a company located in Goodlettsville,TN. The model and serial numbers are: 1st floor unit – Model YHJD18S41S2A and Serial W1H4051255; and 2nd floor unit – Model YHJD24S41S5A and Serial W1F4791417. In September 2017, we learned that the coils were leaking refrigerant. After doing a little research, we learned that there was a class action lawsuit filed against York Company for defective air conditioning coils, so this obviously has been an issue nation-wide. Anyway, we had Universal Heating & Cooling come out to replace the evaporator and condenser coils on October 12, 2017. They used York coils in the replacement. The parts were free (covered under the existing warranty), but we paid Universal $2350 for labor. We learned yesterday, May 6, 2018 that at least one air conditioner is again leaking. It appears that the York coils sent to Universal are again defective. I called the manager of Universal Heating and Cooling. She said the leaking coil is not their (Universal’s) responsibility. She informed me that I should contact York. She indicated there is no warranty for labor. If we asked Universal to come out again to make repairs, they would have to charge us for labor. I want to know what are our options, if any. These are units less than 4 years old, and I had them repaired on October 12, 2017. The repairs were made about 6 months ago using York parts, which apparently are again defective. We have asked our property manager to get a different vendor to make the repairs, without using York parts. -Gary Roberts

  8. TINO RODRIGUEZ says:

can I espect to get a check this year?

  9. Freda Goodson says:

According to PACER an appeal was just filed on this settlement. So dont expect disbursement for atleast 9 mos to a year from now SMH!

  10. Tony Triano says:

Emailed the claims administrator about when to expect distribution of claims, this was their answer (or lack thereof)

Thank you for your email. We have received your Claim Form.
