A settlement has been preliminarily approved between York International and Johnson Controls Inc. (JCI) and a group of consumers who allege the companies sold defective copper evaporator coils and copper condenser coils.

An evaporator coil is a part of an air conditioning system or heat pump system and is inside your house. A condenser coil is a part of a condensing unit and is outside your house.

Three plaintiffs filed the lawsuit on June 5, 2015 (two additional named plaintiffs joined the lawsuit later) claiming the defendants manufactured and sold air conditioning systems and heat pump systems, including air handlers and packaged HVAC units, containing defective copper evaporator coils and copper condenser coils that corrode and leak refrigerant.

The class action lawsuit alleged that the copper coils are made using uncoated copper tubing and are susceptible to corrosion. Specifically, a kind of corrosion called formicary corrosion that causes microscopic tunnels to form within the copper tubing and causes the coils to leak refrigerant.

The plaintiffs contend that JCI knew or should have known about the defective copper coils and along with informing customers about the defect, should have replaced the defective copper coils rather than simply replace the refrigerant in the unit when the copper coils leaked.

Under the terms of the proposed settlement deal, JCI and York have agreed to pay eligible Class Members who experienced one failure of a Copper Coil while the Copper Coil was covered by the original limited five-year warranty or extended 10-year warranty and incurred any out-of-pocket expenses as a result of that failure, a $75 Service Rebate Certificate valid for one year from the date it is issued, to be used as payment for maintenance on their HVAC system performed by an authorized JCI dealer.

Class Members who experienced two or more failures of a Copper Coil while the Copper Coil was covered by the original limited five-year warranty or extended 10-year warranty, and paid for labor, refrigerant, or parts associated with the replacement of their Copper Coils, will receive a check as reimbursement for their out-of-pocket expenses of up to $550 for each replacement (but no more than $1,100 for all replacements).

Those who experienced a first failure of a Copper Coil while the Copper Coil was covered by the original limited five-year warranty or extended 10-year warranty, will receive at no cost a new Aluminum Replacement Coil, plus a $75 Service Rebate Certificate valid for one year from the date it is issued, to help defray the cost of the installation of the Aluminum Replacement Coil or to be used as payment for maintenance on their HVAC system performed by an authorized JCI dealer after the date the Service Rebate Certificate is issued.

All settlement Class Members who experience two or more failures of their Copper Coil while it is covered by the original limited five-year warranty or extended 10-year warranty, if at least one of the failures occurs after the settlement approval date, and paid for labor, refrigerant, or parts associated with the replacement of their Copper Coils, will receive at no cost a new Aluminum Replacement Coil, plus a check as reimbursement for their out-of-pocket expenses of up to $550 for each replacement (but no more than $1,100 for all replacements).

The new Aluminum Replacement Coil will be provided through any authorized JCI dealer.

The settlement also provides $1 million in attorneys’ fees, $25,000 in court costs, and a $2,500 service award for each Class Representative.

JCI denies all of the claims in the lawsuit, but has agreed to the settlement in order to avoid the cost and uncertainty of litigation.

Class Members who wish to exclude themselves or object to the terms of the settlement must do so by Mar. 7, 2017.

Who’s Eligible

You are an eligible Class Member “if you are an individual or entity in the United States who during the time period from January 1, 2008 to November 22, 2016 purchased an uncoated York, Fraser-Johnston, Luxaire, Coleman, Evcon, Guardian, Champion, or Dayton brand copper evaporator coil or copper condenser coil manufactured and sold by JCI or any of its Affiliates, separately or as part of a split system or packaged residential air handler, condensing unit, or HVAC unit, that is covered by the original limited five year warranty or extended ten year warranty.”

  • Claimants who prior to Nov. 22, 2016 experienced one failure of their Copper Coil while the Copper Coil was covered by the original limited five-year warranty or extended 10-year warranty and incurred any out-of-pocket expenses as a result of that failure, will receive a $75 Service Rebate Certificate valid for one year from the date it is issued, to be used as payment for maintenance on their HVAC system performed by an authorized JCI dealer after the date the Service Rebate Certificate is issued.
  • Class Members who prior to Nov. 22, 2016 experienced two or more failures of their Copper Coil while the Copper Coil was covered by the original limited five-year warranty or extended 10-year warranty, and paid for labor, refrigerant, or parts associated with the replacement of their Copper Coils, will receive a check as reimbursement for their out-of-pocket expenses of up to $550 for each replacement (but no more than $1,100 for all replacements).
  • Claimants who after Nov. 22, 2016 experience a first failure of their Copper Coil while the Copper Coil is covered by the original limited five-year warranty or extended 10-year warranty, will receive at no cost a new Aluminum Replacement Coil, plus a $75 Service Rebate Certificate valid for one year from the date it is issued, to help defray the cost of the installation of the Aluminum Replacement Coil or to be used as payment for maintenance on their HVAC system performed by an authorized JCI dealer after the date the Service Rebate Certificate is issued. The new Aluminum Replacement Coil will be provided through any authorized JCI dealer.
  • Authorized Claimants who experience two or more failures of their Copper Coil (if at least one of the failures occurs after Nov. 22, 2016) while the Copper Coil is covered by the original limited five-year warranty or extended 10-year warranty, and paid for labor, refrigerant, or parts associated with the replacement of their Copper Coils, will receive at no cost a new Aluminum Replacement Coil, plus a check as reimbursement for their out-of-pocket expenses of up to $550 for each replacement (but no more than $1,100 for all replacements). The new Aluminum Replacement Coil will be provided through any authorized JCI dealer.
Proof of Purchase

To recover under this settlement, you must include with your claim, evidence that between Jan. 1, 2008 and Nov. 22, 2016, you purchased an uncoated York, Fraser-Johnston, Luxaire, Coleman, Evcon, Guardian, Champion, or Dayton brand copper evaporator coil or copper condenser coil, separately or as part of a split system or packaged residential air handler, condensing unit, or HVAC unit such as an invoice, receipt, photograph, owners’ manual, or registration card.

In order to receive a $75 Service Rebate Certificate, you must provide evidence of the copper coil failure such as an invoice(s), receipt(s), photograph(s), correspondence to or from JCI or an HVAC dealer or contractor, warranty claim(s), or any other competent evidence of the failure.

To receive cash reimbursement for labor, refrigerant, or parts incurred in connection with the replacements of two or more copper coils, you must provide proof that the copper coils were replaced and evidence of the amounts you paid out-of-pocket to replace such coils. You may do so by submitting, for example, invoice(s), receipt(s), cancelled check(s), credit card statements, or any other competent evidence of your out-of-pocket losses.

Copies of these documents must be attached to the Claim Form.

Claim Form Deadline

The deadline for eligible Class Members to submit a claim is the later of:

  • 120 days after the date of the Court’s Final Judgment and Order of Dismissal; or
  • 120 days after the Class Member experiences a Copper Coil failure while the Copper Coil is covered by the original limited five-year warranty or extended 10-year warranty

    I’m having similar problems with Enertech, a new install in 2010, now the replacement coils are estimated at over $1200.00, this is not right when you spend so much for a GEO system and it does not last longer than six years. I believe the HVAC industry is promoting profits for themselves and not a service to their customers.

    If there is a law suit against carrier count me in.we built new home in 2012 the ac leaked in 2013,2014,2015, replaced fault coils in 2016 after installing coils installer found new coils defective, Had to replace coils twice! Cost out of pocket $1400.00 finally ac works,George Bauer

    I bought a new Rheem unit less than 4 years ago and have already paid $580 in parts and labor. If there is ever a class-action lawsuit against them, count me in.

      Have same problem with my Rheem. You may report to your state Attorney General/consumer affairs along with reporting to the Federal Trade Commission. Through investigation, discovered that one class action lawsuit has already closed, but told by attorney to save copies of all receipts, labor costs etc. Any questions—you may reach me at dcanez@sazlegalaid.org.     I have the same situation going on with my Heil system that was all brand new in 2010. In 2012 the evaporator coil failed so I had to pay for labor and recharge of expensive Puron 410a refrigerant. Now it is out of refrigerant again and as I write this I am waiting for the repair guy to show up. For the HVAC contractors who do shoddy work with defectively designed parts, it is all good for business. However, consumers are being shafted and the environment threatened by all the leaking refrigerant. This stuff is not okay for humans to be breathing either. I would like to see a more serious and all encompassing lawsuit be brought against the industry.

    Why don’t they have a class action against RHEEM for faulty coils as well. That’s what happened to mine – and the articles I have researched indicated RHEEM was fully aware of this. However, here in Florida – Morgan & Morgan doesn’t seems it’s worthwhile to pursue money people paid out of pocket to have there units repaired so they would work. I paid close to $1000.00 out of pocket.

    Purchased a new York system in 2008. In 2012 lost all freon due to a leak. They replaced the A coil for $1200. Still have a leak so every spring I’m paying $180 for 3 lbs of freon. Pissed that I was not informed by York that they used shitty parts and was not informed at all about this lawsuit.

      Fraser Johnston hvac split system purchased in 2011. Had first coil go out a couple of months, still waiting for the replacement coil from JCI / York. This class action suit is a joke… I was told 1200. for labor to replace the coil on a barely 6 year old unit… This is not acceptable… The unit has always had a vibration and also has not ran correctly since the install. I have called the installer, also he is the dealer for my area.. He comes out and fixes it for the moment and then the cycle repeats.. The heater also would not come on at times, installer said it was a missing plate on the igniter and rigged the plate to fit and fix.. This unit has been a piece of junk since I purchased it…. 4800. later and don’t know what else to do about it other then just buy a new unit.. Believe me it will not be any unit made by these idiots… These unit should have been completely recalled.. grrr

    We have had our Luxaire 13 months and it just died so only eligible for $75. So far out cost of all the refrigerant, labor, needing to come out again to replace the coil which will cost $800. This is a lousy settlement with a company that did not stand by their products. I will speak badly of Luxaire forever.

    I have the HVAC system installed and June 2014. In my Opinion it is just a problem waiting to happen. How are the people going to be compensated that nothing is wrong yet but most likely there will be a problem in the future?

    does this included Goodman AC/Heat Pump I have to have a repair guy come out and could not find a leak but was losing my Freon and having to get up to 3 pounds every 3 to 4 months on my first every call I was told that repairs was not covered on my unit I do have my paper work when it was purchased
