Persons who received certain automatically-dialed cell phone calls from IC System can now claim benefits from a $3.35 million class action settlement.

This IC System class action lawsuit was filed in December 2012 by plaintiff Michael Reid. Reid claims he received automatically-dialed phone calls on his cell phone from defendant IC System. The defendant continued placing these calls even after Reid asked it to stop calling, he claims.

Reid alleged IC System placed these calls in violation of the Telephone Consumer Protection Act. This federal law allows persons who receive certain kinds of unconsented and automated phone calls to bring a civil claim against the caller. Each phone call made in knowing violation of the TCPA can subject the caller to as much as $1,500 in statutory damages.

The parties worked on a settlement agreement through three day-long mediation sessions and several follow-up negotiations. The first two drafts of the settlement failed to earn preliminary court approval, both times because the proposed Class definition was too inclusive, potentially resulting in too little recovery per Class Member.

The court granted preliminary approval of the third draft, submitted in August 2016. The settlement requires IC System to create a settlement fund worth $3,350,000. This fund will be used to cover the costs of settlement administration, taxes, incentive award for Reid for serving as class representative, and class counsel’s attorneys’ fees and court costs.

Once those expenses are covered, remaining funds will be distributed among qualifying Class Members who submit valid and timely claims. Claims may be filed by mail or phone, or online through the settlement website.

IC System continues to deny Reid’s claims. The company has agreed to this class action settlement only to avoid continued litigation. The settlement does not require IC System to admit any fault.

Class Members have the option of objecting to the settlement’s terms or excluding themselves from the settlement. Those who wish to object or be excluded must file a written request by Feb. 19, 2018.

Who’s Eligible

The settlement Class covers all persons who, between Dec. 14, 2008 and Nov. 9, 2017, were called on a cell phone by IC System using an automated dialer or prerecorded message and whose phone number was associated in IC System’s records as a wrong number call.

Payments will be distributed on a pro rata basis after other settlement expenses have been covered. The amount of each payment depends in part on the number of timely and valid claims received.

Proof of Purchase

Class Members are required to provide their name, a claim identification number assigned to them in their emailed notice (if available), and a current address to which payment can be sent. The Claim Form requests other information, including the phone number at which the Class Member received one of the phone calls at issue.

The online Claim Form asks for the 8-digit Unique ID from the Class Member’s emailed notice and the first three letters of the name to whom the notice was sent.

Entitlement to benefits will be verified according to IC System’s records.

    Lucky. I reported how regional acceptance had called my gf phone after being told to remove from records and no permission to call.. about 20 calls.. then they called my mother and tricked her into paying $1000.00 onto the account. They only had permission to call my cell phone. How’d they get her number? I’ve reported regional acceptance to the appropriate federal agencies and to attorneys and nobody has moved a muscle. And a reply to submit the complaint to this website is pointless. Have done so 3 or 4 times in 6 months with no result.

    The settlement deadline will probably be extended. To date, the claims administrator has yet to notify the class about this. Meaning they haven’t send e-mails or mailed postcards. 10,000+ claims have been filed and less than 200 claimed valid numbers in the class list. If the judge doesn’t extended the deadline then the qualified people will receive around $8,000, but the judge will more than likely extend this deadline since the claims admin has failed to do their job

    I filed a claim maybe a month ago because I’ve gotten the calls and I haven’t heard anything. This company also has reported to my credit FOUR times for the exact same debt. It’s a debt from AT&T that I thought was settled years ago. I’ve never even had AT&T.
