Hylands Inc. has agreed to settle a class action lawsuit over allegations it made false and misleading statements about the effectiveness of certain homeopathic products for children.
If you purchased certain Hyland’s homeopathic products for babies or children between March 8, 2008 and March 30, 2017, you may be entitled to a refund from the Hyland’s class action settlement.
The Hyland’s products named in the homeopathic products settlement include:
- Cold ‘n Cough 4 Kids
- Cough Syrup with 100% Natural Honey
- Sniffles ‘n Sneezes 4 Kids
- Cold Relief Strips 4 Kids with Zinc
- Nighttime Cold ‘n Cough 4 Kids
- Complete Flu Care 4 Kids
- Baby Teething Gel
- Baby Cough Syrup
- Baby Gas Drops
- Baby Infant Earache Drops
- Baby Nighttime Tiny Cold Syrup
Plaintiffs Enzo Forcellati and Lisa Roemmich filed the Hyland’s class action lawsuit which alleges Hyland’s made false and misleading representations about the effectiveness of the products listed above, in violation of state and federal law.
According to the class action lawsuit, Hyland’s falsely represents that its homeopathic products “provide fast, safe and effective relief from cold and flu symptoms.”
The plaintiffs argue that homeopathy is pseudoscience, and that Hyland’s homeopathic products are “nothing more than sweetened, flavored water with only highly diluted concentrations of the products’ so-called ‘active ingredients.'”
The Hyland’s class action lawsuit states that at the time of purchasing these homeopathic products, the plaintiffs were unaware that the items were not proven to be effective for treating cold or flu symptoms.
After five years of litigation, the parties reached a settlement deal that is expected to provide unlimited full refunds to all Class Members who provide a proof of purchase. Consumers who purchased covered products during the Class period but are unable to submit a receipt can file a claim for a maximum of two items for a full MSRP cash refund.
In addition to offering financial relief to Class Members, Hyland’s has also agreed to pay $2.9 million in attorneys’ fees, $5,000 to each Class representative and provide injunctive relief by including a “money back guarantee” for its homeopathic products through its website.
Hyland’s denies any wrongdoing but has agreed to settle the homeopathic products class action lawsuit to avoid the expense and uncertainty of ongoing litigation.
Class Members who would like to opt out of or object to the Hyland’s class action settlement must do so no later than June 28, 2017.
Who’s Eligible
Class Members of the homeopathic products settlement include anyone who, between March 8, 2008 and March 30, 2017, purchased any of the following Hyland’s products: Cold ‘n Cough 4 Kids; Cough Syrup with 100% Natural Honey; Sniffles ‘n Sneezes 4 Kids; Complete Flu Care 4 Kids; Baby Teething Gel; Baby Cough Syrup; Baby Gas Drops; Baby Infant Earache Drops; and Baby Nighttime Tiny Cold Syrup.

Full refund.
Class Members who are able to submit a proof of purchase along with their Claim Form will receive a full refund for all covered products purchased. Those who are unable to submit a receipt, will be able to claim up to two Class products for a full cash refund in the amount of the manufacturer’s suggested retail price.
Proof of Purchase
In order to receive a full refund for covered products, Class Members must submit a proof of purchase in the form of a receipt, product packaging, product containers, or a credit card statement that could prove you bought one (or more) of the Class products. Those who are able to include proof of purchase with their Claim Form will receive the actual price paid. If you are submitting a proof of purchase that does not include the actual price you paid for the product, you will instead receive the MSRP for each item you are claiming.
Class Members who do not submit proof of purchase will be limited to a refund of the MSRP for two Class products purchased.

Why is this being bumped posted as “May 30th” when it was clearly earlier since comments go back to April?

I worked in health food stores for many years and sold many, many products of Hylands and used it myself for my own child. Both I and the customers I served found their products to be safe and highly effective. It’s a shame that some people will stoop to calling homeopathy a sham. I try to be a good consumer and will participate in a class action lawsuit, if the company has violated my trust or produced a bad product, but I feel this is going too far. Highlands has been around forever and I can’t believe that they have been successfully screwed period I will continue to buy their good products as they are some of the best on the market and I hope they’re loyal customers will do the same because it would be a shame for such an old and respected company to go OOB of some idiots

I am in HIGH AGREEMENT with you, I have been using their products since 1999 and highly recommend them to anyone who asks how I would treat a child with whatever ailment they might encounter and I have ALWAYS said Hylands Homeopathic products and will continue to do so.

I agree. I am NOT a shareholder and have loved using this brand for many years. Excellent products. Sad that some jerks blame a cold on this company.
The arnica tablets are excellent. Works really well. My favorite brand for arnica and I am picky. I think this suit is ridiculous. Nothing guarantees you wont get a cold.
Keep buying the products, they will need the money to pay for the ones they took advantage of . No need to call us greedy, call them greedy . You must be a shareholder. By the way, what are you doing on this site if your not looking for some bad products to get a little pay back. I am sure you have filed in the past.
What are your damages? How did they take advantage of you? I am not a shareholder. But someone who happily uses their products. And an email was sent to everyone who has bought the products. I got the email from Amazon and found it absolutely ludicrous.
So sure, get your $19 and such. Hope it makes you feel better taking advantage of a company that has done nothing wrong.
And I have NEVER filed against hylands or jumped on any of these bandwagon lawsuits. But if pointing fingers makes you feel better, then so be it.

I have the bottle but not receipt
I believe it says in the paragraph under the claim that you can submit the bottles for proof. You have to actually go into the claim form and it tells you where to send them to.
