Settlement checks have been mailed for a Hyland’s homeopathic products class action settlement as well as a Burger King BOGO class action settlement.
Top Class Actions viewers are reportedly receiving checks from Hyland’s worth as much as $30.45 and a $2 Burger King gift card from the two different settlements.
Burger King BOGO Class Action Settlement
Plaintiff Koleta Anderson accused Burger King of charging more for two “Croissan’wich” sandwiches bought with a buy one, get one free coupon than they charge for one sandwich bought without a coupon.
Anderson claims that this was false advertising on the part of Burger King as the coupon did not really offer the discount advertised.
During the course of litigation it was discovered that in some states, customers may have indeed paid more for the sandwiches than they should have, especially at those locations that used a certain cash register system. An investigation discovered that the pricing for the sandwiches varied across states and Burger King locations.
Allegedly, consumers were overpaying by as much as a dollar for the “buy one get one” deal, but the problem occurred in less than 10 percent of sales.
The company determined that continuing to litigate would not be advantageous, so by October 2017, the two parties had reached a preliminary settlement and submitted it to the court. The agreement stated that Burger King would provide cash payments for consumers who could submit a receipt for their Crossan’wich purchase, and a gift card to those who could not produce a receipt.
Additionally, in accordance with the settlement agreement, Burger King has updated its point of sale system to avoid further pricing discrepancies, and has instructed employees to manually ring up the lower priced Crossan’wich when it is appropriate, and then to credit a customer for their coupon.
Despite their agreement to a settlement and the changes they have agreed to implement, the company denies any wrongdoing.
The deadline to file a claim for the Burger King BOGO class action settlement was Jan. 19, 2018.

The Burger King BOGO Crossan’wich Class Action Settlement is Anderson v. Burger King Corp., Case No. 8:17-cv-01204, in the U.S. District Court for the District of Maryland.
Hyland’s Homeopathic Products Class Action Settlement
Another class action lawsuit has come to an end as consumers are receiving checks in the mail. In June of last year, Hyland’s Inc. agreed to settle a class action lawsuit alleging that it made false claims about the efficacy of its homeopathic remedies on children.
Consumers Enzo Forcellati and Lisa Roemmich alleged that the company violated state and federal laws by claiming that the homeopathic products provided “fast, safe, and effective relief from cold and flu symptoms,” when in reality, the products are based on “nothing but pseudoscience,” and were not proven to be effective in treating cold or flu symptoms.
Consumers and the company litigated for five years, a process which ended in a settlement deal made in June 2017. According to the deal, all consumers who provided proof of purchase for items bought between March 8, 2008 and March 30, 2017 received a full refund.
The deadline to file a claim for the Hyland’s homeopathic false advertising class action settlement was June 28, 2017.
