Hyland's class action lawsuitU.S. District Court Judge George H. King found that a group of plaintiffs who alleged that cold and flu remedies were ineffective beyond the placebo effect had satisfied the Rule 23 standards in seeking certification of a Hyland’s homeopathic remedy false advertising class action lawsuit.

Members of the nationwide class action lawsuit include all consumers who since March 8, 2008 bought one of the following products:

1. Cold ‘n Cough 4 Kids,
2. Cough Syrup with 100% Natural Honey 4 Kids,
3. Sniffles ‘n Sneezes 4 Kids,
4. Cold Relief Strips 4 Kids with Zinc, and
5. Nighttime Cold ‘n Cough 4 Kids.

Due to a similar California legal action, residents of the other 49 states who purchased Hyland’s Complete Flu Care 4 Kids in that same timeframe may also be eligible to join the class in whatever jury award or settlement may be achieved. The result came after Judge King found the arguments of the homeopathic remedy maker less than compelling, from governmental interest analysis to an attack of the commonality of the plaintiffs.

He wrote in the decision that the lead plaintiffs allege that Hyland’s engages in false advertising in representing that “their homeopathic products provide fast, safe and effective relief from cold and flu symptoms.” They further go on to argue that “homeopathy is pseudoscience” and that as a result of the preparation procedures, the products contain “highly diluted concentrations of the products’ so-called ‘active ingredients.'”

That phrasing is key in considering whether or not the plaintiffs have a common legal question that can be remedied through the efforts of their class action lawsuit attorneys. The defense team had argued that because each of the homeopathic cold and flu remedies contained different ingredients, that there were no common questions of fact and that the case should proceed, if at all, divided by products. Judge King decided that was not the case.

After all, the plaintiffs “are challenging the products’ common homeopathic preparation … and lack of scientific testing” leading to the conclusion that the products “contain no active ingredients at all because of their common homeopathic dilution.” If that is the case, then it does not matter what herbs and other elements are included in the treatments.

    OMG!!! This is so stupid, if the defense wants to contact me anytime I am very willing to attest to my experience with this products. Now due to this lawsuit it is impossible to get this medicine for my kids!! And they are allergic to Tylenol and Advil and mo-trim and EVERYTHING else that is prescribed by doctors I NEED THIS PRODUCT BACK ON THE MARKET!!!!!! My 2 sons and 8 nephews have had the same amazing results with the cold n flu tablets they always stop congestion within the first two doses. I bet the other parents altered the specific instructions written in the label since my sister did that the first time and she complained to me that it wasn’t working for her son, so I asked if she gave him the two tablets and she said well no I decided to only give him one and I yelled to her to give him the complete dose of two tablets at a time and after that her baby got all better within two days. My kids also get better within a day or two.

    That is garbage, their products work great. I have used them ever since my kids were babies and my son is now 9 and my daughter is 6. They have neither one ever been to the doc. and received antibiotics for any kind of cold, flu, cough, or earache. Yet my friends who have kids have their children in the docs. office at least 3 times a year or more for the same illnesses, because the meds the docs give out are not affective any more. This is crap and another way for the government to stop homeopathic companies from helping people in major stores where the products are more accessible.

    This lawsuit is ridiculous. Many people don’t understand homeopathic science, and because of this no wonder some remedies are ineffective. Do your research. Strong essential oils, mint, chemicals and various preservatives found in artificial foods will render this sensitive remedy ineffective. Do your research before you buy a product.

      I agree! I have used these products for years! Some worked and some did not. It is that way with every other remedy, homeopathic or prescription. No need for a lawsuit unless some dramatic illness was caused from a normal dose. Craziness!
