Sterling Valley Systems Inc., doing business as Inntopia, has reached a settlement in a class action lawsuit related to a data breach.
The personal information of 17,952 Inntopia customers was accessed and stolen on or around Feb. 18, 2022, and those affected are members of the class if they were sent notice of the data breach.
In addition, there is a subclass of California customers whose information was part of the data breach.
Inntopia is accused of not properly protecting the plaintiffs’ personal information nor properly monitoring the data to make sure it was not intercepted. Inntopia also should have found that the data had been compromised sooner, the lawsuit alleged.
Inntopia is a marketing company that manages websites where sales are made for many companies. It is therefore even more important for the personal data and payment data that the company comes in contact with from many users to remain secure.
Class members are eligible for the reimbursement of up to $500 in out-of-pocket expenses that can be documented as connected to the data breach, such as additional travel costs, cellphone charges, data charges, bank fees, gasoline for local travel and fees for credit reports or credit monitoring.
They are also eligible for up to three hours of pay, at a rate of $20 per hour, for documented lost time reimbursement due to the Inntopia data breach.Â
Class members also are eligible for up to $3,500 of documented extraordinary loss reimbursement for documented monetary losses.
California subclass members are eligible for $75 per person of cash payment for the data security incident.
All class members are also eligible for two years of free credit monitoring and identity theft protection services through IDX.
The Inntopia data breach settlement exclusion and objection date is Oct. 31, 2023.
A final fairness hearing in the Inntopia settlement will take place Jan. 9, 2024.
The claim form deadline is Nov. 30, 2023.
