The Magellan Health nationwide $3.75 million class action lawsuit settlement came after a 2020 phishing incident and data breach at the company.

The class includes current and former Magellan Health employees along with consumers whose information was part of the data breach. There are two separate classes in the settlement: the  Common-Fund Settlement Class for those who were notified that their Social Security numbers were compromised in the breach, and the Claims-Made Settlement Class for those whose Social Security numbers were not compromised.

The compromised data included both the personal information and the personal health information of the employees, former employees and consumers.

Magellan Health is a managed-care health care company that has more than 110,000 providers, 20-plus years in specialty health management and 50-plus years working in behavioral health. Magellan works with employers and government entities to provide health care solutions for individuals.

For class members in the Common-Fund Settlement Class, the Magellan Health data breach settlement will provide a $100 cash payment that may be adjusted up or down based on the number of claims approved and in lieu of any other benefits.

That class can also file for up to $5,000 in documented expense reimbursement for data-breach-related expenses, including five hours of time reimbursement at a rate of $25 per hour. 

Claims-Made Settlement Class members whose Social Security number was not compromised in the Magellan Health data breach can file for up to $750 in documented expense reimbursement, including up to three hours of lost time reimbursement at a rate of $20 per hour, and 12 months of identity theft protection.

The exclusion and objection deadline is Nov. 21, 2023.

A final fairness hearing in the Magellan Health data breach class action lawsuit settlement will take place Feb. 8, 2024.

The claim form deadline is Dec. 21, 2023.
