90 Degree Benefits agreed to a $990,000 class action lawsuit settlement to resolve claims that it failed to prevent two 2022 data breach incidents that compromised health information and personal identifiers. 

The settlement benefits individuals who received a notification from 90 Degree Benefits informing them that their personal information and protected health information may have been compromised in data breaches that occurred in February and December 2022.

The data breach class action lawsuit claims that 90 Degree Benefits failed to implement reasonable cybersecurity measures that could have prevented two data breaches in February and December 2022. As a result, hackers allegedly gained access to sensitive identifying information and personal health data.

90 Degree Benefits is a health benefits company that serves 525,000 members across the country.

90 Degree Benefits hasn’t admitted any wrongdoing but agreed to a $990,000 settlement to resolve the data breach class action lawsuit.

Under the terms of the settlement, class members can receive up to $5,000 for data breach-related losses such as fraudulent charges, identity theft damages, credit expenses and more. This reimbursement limit also includes compensation for up to three hours of lost time compensated at a rate of $25 per hour.

All class members are eligible for one year of free identity theft protection and credit monitoring services.

Instead of receiving payments for data breach losses and free credit monitoring services, class members can opt to receive an alternative cash payment of $50.

The deadline for exclusion and objection is Oct. 17, 2023.

The final approval hearing for the settlement is scheduled for Nov. 16, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Nov. 16, 2023.
