A $60 million settlement has been reached between the makers of the opioid addiction medication Suboxone and the Federal Trade Commission.

According to the FTC, Indivior Inc. and its subsidiary Reckitt Benckiser Group, conspired to prevent a lower-priced generic version of Suboxone from interfering with its significant pharmaceutical sales.

The settlement benefits all U.S. consumers who were prescribed Suboxone Film between March 1, 2013 and Feb. 28, 2019. The payout amount will depend on the number of total claims filed and how long the consumer was prescribed Suboxone film.

The FTC anticompetitive lawsuit notes that Indivior falsely marketed its Suboxone Film as being “less susceptible to accidental pediatric exposure than Suboxone Tablets,” right before a generic version of Suboxone tablets entered the market.

This misleading claim reportedly forced many consumers to switch to Suboxone Film which was the more expensive option.

The FTC states that Indivior even went so far as to submit a petition to the Food and Drug Administration in 2012 with statements that “Suboxone Tablets had been discontinued due to safety concerns about the tablet formulation of the drug.”

“In the midst of the nation’s opioid crisis, a critical opioid-addiction treatment was about to become more affordable,” said Gail Levine, a Deputy Director of the FTC’s Bureau of Competition. “But Indivior prevented that. It kept its drug prices high by unlawfully impeding generic manufacturers from competing effectively.”

The Suboxone lawsuit claims that Indivior engaged in improper business practices that didn’t allow competition thus violating Section 5 of the FTC Act.

Under the terms of the FTC settlement, consumers must file a claim no later than Dec. 1, 2020 to get a refund check.

Who’s Eligible

U.S. consumers who were prescribed Suboxone Film between March 1, 2013 and Feb. 28, 2019 are eligible to file a claim for this FTC settlement.

Potential Award

Varies. 

The payout amount depends on how long the consumer took Suboxone and how many claims are submitted overall.

Proof of Purchase

Not required at this time. However, consumers are encouraged to save any supporting documents in case the settlement administrator has questions later on.

        They said its bout a month or 2 from the deadline date that it takes for it all to be looked at n sort the ones qualified their shares n send but if u ask them they can give u that info. Other than the site updates its contacting them if u have questions n concerns

    You have to add yourself. There is a link on this page to fill out a claim. Nobody is just going to add you up it doesn’t work like that. If you want in you have to fill out the claim form.

    Suboxone is morphine based that’s why when on suboxone if you break your leg the only thing that the er can give you is fentanyl and that’s why they give babies that are born addicted to suboxone morphine to withdrawal from it and you can overdose using suboxone but you had to be misusing it or taking other illegal drugs with it for you to overdose I am a nurse

      Buprenorphine/naloxone is a medication that works in the brain to treat dependence on opioids. Opioids include heroin and prescription pain relievers such as hydrocodone, oxycodone, morphine, and fentanyl. I copied this from NAMI u really need more education on this n u don’t sound like a legit nurse. Not from the yrs ive spent living with drs nurses or the rehabs I been to nor the hospitals so whoever told u that or educated u they are bs. Idc who it was but thats not nearly correct. I graduated from a class that educated us on opiates n the recovery process n morphine wasnt ever mentioned other than being another opiate. Suboxone is buprenorphine n naloxone ONLY nothing to do with morphine. Plz get a proper understanding before u say shit thats nothing to do with anything here or making sense of it. Coming from the “nurse” u claim to be that sounded like straight bs since its clearly noted wtf it is n is not. Im just very straight up n this page isn’t for that kind of comment specially when its not the correct info.

      No tf it isn’t. For a nurse u sound fake. Read up n educated yaself before u say anything. Morphine has nothing to do with suboxone. Its 2 ingredients n morphine isn’t anything mixed or based whatsoever. U obviously never been on it so why are u even in this claim or commenting?

      It’s to make up “some” of the difference from what name brand suboxone strips cost compared to what a generic brand could have sold them for. That’s the whole point of this lawsuit. Because the makers of suboxone wouldnt allow other companies to produce a generic film. They were a monopoly. Causing most of us to pay out of pocket. I had insurance but it wouldnt cover the “suboxone” brand films. Go figure. As soon as they generics came out last year my prescription went from almost $400 a month down to $15. I dont think anyone that only had to pay a $15-$30 copay will recieve anything. Seems to be how they are pitching it.

    I got off suboxone after 8 years with little to no withdrawal symptoms. Hate the drug with a passion and willing to help anyone or share my story. About half of those years I paid out of pocket. I will be filing (don’t have any records of these suboxone purchases hoping the pharmacy does.

      I’d love to chat! I’ve been chained to Suboxone for over 7 years! I’ve stayed clean of other opiates and have negative drug screens to prove that-every single month-for the last 7 years! I have my normal life back. I work full time. My husband and I own our own house. I’m a mother to 2 very bright and talented girls! I have everything I could have ever dreamed of having in my drug-free life! Yet-I still cannot break this chain to Suboxone! I’ve tried and failed too many times to count! I’m in therapy, I always keep my appointments. I don’t sell my Suboxone. I don’t buy anyone else’s Suboxone! I’m a great person. I come from a great family! I’m just CHAINED to this so called “miracle drug!” Please help me!!!!!

      This is great Juston. I’m on it for 15 years. I will add that it is the only thing that worked for me and has allowed me a beautiful drug feee life (other than the prescription) following a revolving door of prison. I would love to get off it as it does feel humiliating and owned by doctors. The judgment attitude of health care professionals is disgusting. Like a dentist who asked what meds your on, or when walking into an urgent care for a cold. The stigma is real. Yet it has worked really well for me. A miracle. Did you have withdrawal? To what extent ? How did u do it?

    I have been prescribed oxycodone and morphine for years now by my PCP for arthritis, neck and back pain, sciatica, capitular tunnel syndrome, and pain in my limbs due to diabetes,, and did I mention the migraines? My teeth are shot,, and I went to Clear Choice To find the price tag for implants would be $42K. I entered the class action lawsuit against Purdue Pharma,, but after the settlement has heard nothing from them. I am addicted to them. to titer all, my PCP and me tried in increments to no avail.
    I am also addicted to nicotine gum having been off tobacco and alcohol for 13 years. I was a heavy smoker; pipe, rolled my own, regulars, cigars, snuff.and chewing. It was a dirty habit. Nicotine gum is an expensive habit.
    I am old, nearly 70. Matriculated at an ivy League University, Dropped out my Jr. Year and finished my B.A, at a local college with a dual degree twenty years later. Paid all my loans w/o the help of family, in 70’s dollars, a lot today!.My family ostracized me and I battled stigma too. I was a Merchant Marine for a while.
    I want to die solvent. Last month I nearly thought myself to death. Being so depressed with the state of my country, my decrepency and having atrial fib,knowing self-hypnotism I raised my heart rate to over 200 bpm. My g/f called an ambulance and I was hospitalized for three days and nearly coded. I am much happier now, Creding my g/f, our new cat and Joe and Kamala. I never had any progeny, except for cats.
    I don’t abuse drugs but have an addictive personality.
    I graduated with honors but still had to work often for minimum-wage jobs.
    Hope was lacking and I was in a dissociative state.

      I’m on Buprenorphine for chronic pain. I was never an addict. They are phenomenal for my pain relief and daily life. I’m no longer crippled and bed ridden nor housebound. I don’t take these for granted. 22 years of pain and only a couple with traditional pain medications. The addicts were the reason I had to seek out buprenorphine. They are pill form. I feel for you. I’m sorry to hear about your plight and teeth. Go Biden/Harris!

      Please stay strong. Don’t give up. You aren’t a quitter look at all you have accomplished you have a lot to be proud of yourself for. You want to just throw away like a piece of garbage??? I would think not. Get off pity party wagon, it’s for losers and quitters you don’t belong in that class. Take a good look in the mirror and say “I love myself” do this every day when you get out of bed. Life is a gift, gifts are cherished not thrown away.
