A $60 million settlement has been reached between the makers of the opioid addiction medication Suboxone and the Federal Trade Commission.

According to the FTC, Indivior Inc. and its subsidiary Reckitt Benckiser Group, conspired to prevent a lower-priced generic version of Suboxone from interfering with its significant pharmaceutical sales.

The settlement benefits all U.S. consumers who were prescribed Suboxone Film between March 1, 2013 and Feb. 28, 2019. The payout amount will depend on the number of total claims filed and how long the consumer was prescribed Suboxone film.

The FTC anticompetitive lawsuit notes that Indivior falsely marketed its Suboxone Film as being “less susceptible to accidental pediatric exposure than Suboxone Tablets,” right before a generic version of Suboxone tablets entered the market.

This misleading claim reportedly forced many consumers to switch to Suboxone Film which was the more expensive option.

The FTC states that Indivior even went so far as to submit a petition to the Food and Drug Administration in 2012 with statements that “Suboxone Tablets had been discontinued due to safety concerns about the tablet formulation of the drug.”

“In the midst of the nation’s opioid crisis, a critical opioid-addiction treatment was about to become more affordable,” said Gail Levine, a Deputy Director of the FTC’s Bureau of Competition. “But Indivior prevented that. It kept its drug prices high by unlawfully impeding generic manufacturers from competing effectively.”

The Suboxone lawsuit claims that Indivior engaged in improper business practices that didn’t allow competition thus violating Section 5 of the FTC Act.

Under the terms of the FTC settlement, consumers must file a claim no later than Dec. 1, 2020 to get a refund check.

Who’s Eligible

U.S. consumers who were prescribed Suboxone Film between March 1, 2013 and Feb. 28, 2019 are eligible to file a claim for this FTC settlement.

Potential Award

Varies. 

The payout amount depends on how long the consumer took Suboxone and how many claims are submitted overall.

Proof of Purchase

Not required at this time. However, consumers are encouraged to save any supporting documents in case the settlement administrator has questions later on.

    the rep told me it’s for the person who is submitting the claim and it doesn’t matter if you had insurance pay for it or not. because some people pay a co pay or pay a premium for there insurance

    I think my case is pretty bad I was on 3-12mg film’s a day the two years and I overdosed on them not once but twice and what saved me was that my provider knew this Suboxone had Opioid because they gave me Narcan everytime they gave me my monthly 84 single film script so yeah the first time I overdosed my friend new I always would carry my Narcan in my poket and he saved that day along with my brother the next time i overdosed on these freaken Suboxone. So if my provider knew that these Suboxone film’s were 30 or 40 times stronger then morphine and now I know why they gave me Narcan and they didn’t care if I would overdose cause they just wanted their money $450 a month plus intake fees man I hope they get me my money back cause I’m homeless!!!

      That’s such a lie dude! Suboxone has the same ingredient as narcan IN IT plus the opiate used in sub isn’t even the same kind as the types in pain pills or heroin, it has a ceiling effect, meaning at a certain point taking more isn’t gonna have any additional effect. You obviously werent prescribed for pain mgmt but for addiction and must have taken breaks from taking it in order to do “real” opiates and overdosed that way.

      You may have your friends/family fooled with your nonsense lie but I researched the drug before agreeing to take a prescription and it’s been a long time so I can’t remember exactly the right way to word it as far as the type of opiate it is but I would swear on my and my daughter’s life that there’s no way you overdosed ON suboxone!! I’m THAT positive that it is 100% impossible!

      I took it for pain mgmt BECAUSE of the difference in it and other opioids & due to the fact that it wasn’t gonna require ever increasing dosages like other opiates only to still not even keep pain at a manageable level.

      This suit is based on the fact that they didn’t allow generic scripts. This site is hardly the place to be spreading false info about this drug!

        I had to call bull s**t on the person saying they overdosed on subs. It’s impossible to do that due the naloxone in it,which is what narcan is.

      You cannot overdose on buprenorphine and naloxone. The reason you are given a Rx for narcan with your suboxone Rx is due to the fact that addicts relapse and generally when one relapses they overdose; it’s given as a harm reduction tool.

        It is true you can overdose on Suboxone. Only if you are abusing it trying to get high. My doctor told me you can if you take way more than prescribed. Highest I’ve been on it 2, 8mgs tablets a day. Makes no sense why someone would need 3, 12mg strips a day that is excessive.

    Hmm 72 months at over $500 a script, roughly $36,000?? Im guessing we only get a portion of that, like $10-$15 right? This medication is more addictive physically than any ive ever taken, and i was forced on it by a doctor and CPS, i should file my own private suit since im still currently on it and have been since 2011 and have tried getting off of it to no avail for the past 6-7 years. I never shouldve been put on it, no one on just pill opiates should ever touch the crap!

      My drug of choice was pain pills , oratabs, Vicodin ES , 7.5’s and 10’s ..never took heroine and been on Suboxone for 15 years after stopping

    I was on them for 22 months and finally quit almost 4 years ago now. I just stopped one day and took my last little bit. I weened down and never took more than I did the month prior. It honest to god gets easier. It takes a while dont let me fool you. First you think about it every second of every day in an anxious state of impending doom. You watch the hours in anticipation of what you know will be the worst imaginable doom. It may feel like you’re never going to get reprieve. Then after a few weeks I started only thinking about it a few times a day. I woke up and the first thought was coffee, not my body going through physiological torture. I finally felt “better”. It took months, maybe 6, before I’d go a day without counting how many days it’s been. Finally after one year, I stopped counting. It was a long road to then, and longer to now 4 years later. I haven’t relapsed once and I feel as though I have overcome the once overwhelming mountain of detox and psychological reprogramming. I’m sorry for any typos or poor grammar as I’m typing on my phone and I’m not going to revise this. Thought I may be able to if nothing else inspire one person out there to try. Dont ever think for a second that you cant or that its “to hard right now”. You are going to be better than you were before addiction when you get through, I PROMISE.

    Any idea if we will be getting back every penny we paid over? I been prescribed suboxone for 48 months between 2013 and 2019 and i did the calculations, I over paid $23,000, So are we getting all of our money back that we over paid or only some? Thanks

    I think we all understand that this claim is for medication falsely being represented, I know I was paying out of pocket for the medication and doctors appt. I did that for several years scared I wouldn’t be able to afford a medication I truly didn’t want to take. Maybe all of us on the website what to share are stories, I know hearing all of your testimonies really shed light on my journey and I really appreciate hearing everyone.

      I believe so. I used insurance to pay for my monthly prescriptions and I still received the correct amount of money.
