ferrara wage and hour class action lawsuit settlement

Ferrara Candy Company agreed to pay $1.5 million to settle a class action lawsuit that accuses the business of discriminating against potential workers simply because they are African-American.

Plaintiffs Brian Lucas, Aronzo Davis, Torrence Vaughans and Maurice Milton filed the class action lawsuit on behalf of themselves and all others seeking employment at the Ferrara Candy Company, either directly or through two staffing agencies known as Labor Power and REM.

According to the lawsuit, the company limited or completely excluded African-American workers from being hired by Ferrara for positions of Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician or Shipping Clerk.

The plaintiffs claim that they were steered away from available jobs at Ferrara by the staffing agencies who instead hired Latinos for those positions.

Ferrara, Labor Power and REM denied all allegations of wrongdoing but decided to settle the class action lawsuit to avoid the cost of further litigation.

Who’s Eligible

The Ferrara Candy class action settlement is open to all Ferrara Direct Applicant Class Members and all African-Americans who sought a work assignment through REM or through Labor Power and were otherwise eligible to work at Ferrara but were not assigned or hired to work at the company between Feb. 27, 2009 and Dec. 22, 2015.

I got my tax forms I. The mail today, June 18, but deadline was yesterday????? I’m sending mine in and I will call Monday.

  2. Chelle says:

When will we get our checks I want the whole $7500…

  3. Jane says:

I just called the settlement line and was told that 50 % of the claim would count as income and had to be reported to the irs. So the forms must be completed. The number to call for questions is 1-888-586-9841.

  4. Little Muffy Piggy Pants says:

I received the tax forms and Medicare forms, yesterday. The forms are due on the 17th. It is imperative that the tax forms are completed because it ensures that you receive payment. Taxing half of the payment is part of the terms of the settlement. Taxing the settlement sucks but you will get it back when you file your 2016 taxes. You could max out your dependants to lessen your tax burden.

  5. Tony C says:

I was told the only people who need to send the forms back are the ones who have Medicare. If you have Medicare you have to send the forms back with the tax forms if you didn’t you don’t have to send anything back.

  6. Jane says:

I would like to know if we have to send these forms back as well, it states that they must be sent back by June 17. But I never had Medicare and what is this W9 form for reporting income to the irs. I need to find out some answers.

    1. shardra says:

you will find out when you ant got no job then you get money then you cant pay it back at the end, if this the case ,uh no not me irs not going to be breathing down my back, that form is the same thing as being hired , and you didn’t pay money in to it, so it would be hefty, I called a cpa and asked about it.

  7. Bebe says:

yeh but may only get 100.00 each then you got to deal wit the irs. I trashed mine

  8. Yaay says:

Dawn, your comment is very offensive to some of us who is not on welfare and looking for an honest days work. And is exactly why I hope they do approve it for all African Americans. You most be the descendant of a slave owner and beneficiary of my ancestors hard work. And to those of you that feel that way ,all praise to Nate Turner!!!!

  9. John Burks says:
