eMachinesUPDATE: eMachines Extends Cash Option Deadline for Class Action Settlement

On March 25, 2013, a federal court approved a class action lawsuit settlement between eMachines Inc. and consumers who say the company sold defective computers that ruined floppy disks. If you purchased an eMachines computer from a retail store after December 31, 1997, you may be entitled to a replacement computer, up to $365 in accessories, or $62.50 in cash.

The only way to receive these benefits is to submit a valid Claim Form no later than July 15, 2013. Distribution of the Settlement Awards is expected to start in the fall of 2013, according to the Settlement Administrator.

The eMachines settlement will resolve a class action lawsuit (Stroud v. eMachines Inc.) that alleges the defendants sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk. eMachines denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the eMachines class action settlement include anyone who purchased the following computers from eMachines or an eMachines authorized reseller (a retail store) in the United States on or after December 31, 1997:

Class Members have the option to receive one of several benefits. Class Members who complete and submit a valid Claim Form and Proof of Purchase will receive a redemption certificate with a face value of $365 that can be used toward an Acer, Gateway, or eMachines replacement computer and/or accessories. This certificate may also be exchanged for $62.50 cash.

Regardless of which benefit you choose, you will not be required to return your original computer.

The only way to receive benefits from the eMachines floppy disk settlement is to submit a claim form postmarked by July 15, 2013.

    I just got my voucher today….and placed an order today….we will see what happens.

    I ordered a laptop and paid $95 over the claim amount. I ordered it in August and they say it was processed and sent to UPS for shipment. UPS says a shipping label was created but are waiting for the item. It’s been over 3 weeks since I ordered this computer and it has not shipped. I got one email response saying to wait. I was thinking this was a scam but after I found this class action web site it sounds legit, but something isn’t right with what’s going on. Can you take legal action on legal action?

    This settlement is not being conducted in good faith. For over a week now there have been between 0 and 2 laptop offerings. Secondipity is handling the offerings, but has been negligent. On their web site the identical laptop is cheaper than the emachine web site, along with the fact that their offerings are in the 50+ for the Acer laptops.

    In the settlement paragraph 7.2(a)reads: “commercially reasonable efforts to maintain an adequate availability of supply” sic..should be on the web site.

    Given the fact that there were 800,000 people who returned their cards, are we being cheated once again?

    We got one of the two certificates we sent in for, but there has been nothing available to buy on the website!

    Also, you have only 60 days after receiving the certificate to decide you want cash instead, so if they never put up any computers after that, you get nothing!

    People have had a lot of trouble redeeming their certificates even when they do get them. Whatever you do, don’t throw any of the documentation out until you have your computer and whatever warranty they offer has expired!

    From what I can tell, there is no way to reach a live person, so all you can do is write to the Settlement Administrator listed on the Class Action Website. From what I’ve heard so far, good luck ever hearing from them. :-(

    It says you have to file a claim by July 15 2013.
    I didn’t receive my claim form until July 20 2013

    pardon some of the words I used in writing my comments. I was using Dragon NaturallySpeaking which screwed up some words and sentences and I should’ve read it carefully. One comment I made is they’re only offering two brand-new desktops and everything else is refurbished. All I can say is pardon some mistakes made by my comments and words. I wish everybody good luck and success in their recent claim of their certificates.
