eMachinesUPDATE: eMachines Extends Cash Option Deadline for Class Action Settlement

On March 25, 2013, a federal court approved a class action lawsuit settlement between eMachines Inc. and consumers who say the company sold defective computers that ruined floppy disks. If you purchased an eMachines computer from a retail store after December 31, 1997, you may be entitled to a replacement computer, up to $365 in accessories, or $62.50 in cash.

The only way to receive these benefits is to submit a valid Claim Form no later than July 15, 2013. Distribution of the Settlement Awards is expected to start in the fall of 2013, according to the Settlement Administrator.

The eMachines settlement will resolve a class action lawsuit (Stroud v. eMachines Inc.) that alleges the defendants sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk. eMachines denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the eMachines class action settlement include anyone who purchased the following computers from eMachines or an eMachines authorized reseller (a retail store) in the United States on or after December 31, 1997:

Class Members have the option to receive one of several benefits. Class Members who complete and submit a valid Claim Form and Proof of Purchase will receive a redemption certificate with a face value of $365 that can be used toward an Acer, Gateway, or eMachines replacement computer and/or accessories. This certificate may also be exchanged for $62.50 cash.

Regardless of which benefit you choose, you will not be required to return your original computer.

The only way to receive benefits from the eMachines floppy disk settlement is to submit a claim form postmarked by July 15, 2013.

    I got my certificate on August 19, 2013 and I must say I’m very pleased to finally get it. Immediately I had gone on the emachine she and website to place my order. I found a beautiful A700 Acer new 10 inch tablet they were selling for $339 plus I got second day shipping which told $352 and all. I didn’t have to put a credit card number on file because I made sure it would be under the $365 certificate limit. When I checked online after midnight there were no tablets available half the day. Then later I found out they were selling an 8 inch refurbished Acer tablet for the same price but lower quality than what I first got. When you find something on this website take that item use your certificate numbers and buy it fast before it disappears or you might end up with a piece of refurbished junk. These items change daily so keep an eye on them but I would imagine it’s going to get a lot harder to get a decent computer item from this website. It’s a shame that we were sold a defective item 10 years ago and here they’re trying to pass on refurbished computers. They only have so far to brand-new desktops with no monitors that come with some. That’s like giving a child a toy on Christmas with no batteries included. I must say honestly that my old emachine was my first computer since I could not afford at the time top-of-the-line brands. The computer lasted a long time and exceeded my expectations it brought me great joy over the years. I did however by a second emachine after my first one eventually died. The second computer gave me more trouble because it had a crappy operational system on it with errors at the time. I do feel grateful that some good has come out of this 13 year long lawsuit and people will finally got what is due to them. I think everybody knows that the emachine was a low-budget crappy Chinese built computer back in a day. However insurgents purpose for the hard-working man or I should say woman they couldn’t afford a top-of-the-line computer back then since everything was very expensive.when I filled out this little card and put a copy of my driver’s license I was very skeptical about the outcome of this. I was amazed that they tracked me down after all these years. Honestly I didn’t think I would hear back from them since it was a very long time since I sent in that card back along with a copy of my driver’s license. Most of the time when you hear about these million-dollar billion-dollar lawsuits people only get paid maybe five dollars or there is a gimmick applied such as coupons and rebates that people will never use. This is the first time that I have seen an class-action lawsuit I finally done right by its past customers to give them a decent settlement back. I’m not crazy about refurbished computers please don’t get me wrong but let’s face it it’s for free and you can’t look a gift horse in the mouth. That is why I decided to immediately purchase a brand-new Acer tablet while it was online because I knew they would run out of stock real quick. Three hours later they were sold out. I would have liked to seen them offer a better selection of computers on their website that were brand-new instead of 98% that are refurbished. I guess I’m the one of the few lucky ones to get a new one. I don’t blame people for thinking this was some sort of scam cause we all have seen them. But if you checked online you would find out it is a legitimate settlement. What I dislike most about this settlement is that they did not provide a contact number where you can talk to a live representative regarding your order or problems placing the order. I get the feeling that they just don’t want to talk to you and want you to just go away and disappear into the night. another thing that bothers me is that you have to wait 10 business days before they will ship out your product. Why is that the case since I paid for second day shipping which I’m not getting. Some of the items on the website are overpriced and inflated price wise.

    got my claim certificate number in the mail today. promptly went to the website & cashed it in for a windows 8 tablet. check your mail, your letter should be on the way!

    it seems like they have only honored a few of the claims anyway and charged full price from peoples credit cards for these cheap, used high priced computers. anyone who have ever dealt with emachines know the hell they put you through

    I can’t believe I was never notified about this lawsuit me and my brother both purchased one and they both messed up. Neither one of us were notified so by the time we did find out it was too late I’m sure that happened to a lot of unhappy customers

    I recently tried redeeming my voucher for a new computer and got my computer shipped to me. one problem they didn’t apply myvouchwe number and pin to purchase so I was billed the full amount for computer to my bank account. I didn’t find this out till two weeks later when I got an overdraft notice. I had already discarded my certificate letter and I am told that I need it to get this refunded to my account. but I don’t know who to contact to get a new letter mailed to me. emachines.settlement@secondipity.com to no avail. they are asking me for my letter which I emailed and asked them for copy. does anyone have their certificate letter with an address or phone number that I can call to get a new letter sent to me. please email me if you can help
