Details: The Dannon Activia Yogurt Class Action Lawsuit Settlement claimed that Dannon falsely advertised the health benefits of its Activia® and DanActive® branded products. Dannon Activia Yogurt was sold nationwide beginning in February 2006. Dannon’s DanActive drink was sold nationwide beginning in January 2007. So what can you claim? You can claim up to $100 with proof of purchase, $30 without proof of purchase if you send in a paper claim form or $15 if you file an online claim form. The claim process is relatively straight forward. We’ll just detail the online claim form as it’s expected that 90% or more of claims will be made online. Please note, the max you’ll receive doing this is $15. The claim process is the same for those looking for more, they’ll just want to send in a paper claim form (also available at the Settlement Administrator Website) and send it in (including proof of purchase if attempting to claim more than $30.)

 

Head over to the Dannon Activia Class Action Lawsuit Settlement Administrator Website and click on “Claim Form.” Follow the prompts and you’ll soon be filling out the Online Claim Form. On the claim form you must include all of your contact information. Make sure it’s accurate! You’ll also have to fill in the products purchased, date of purchase, and price paid per product. Next you’ll have to enter your name to act as a digital signature. That’s it! You’re done! In this class action the dispute seems to arise from claims that Dannon Activia yogurt and DanActive yogurt are “clinically proven” to help your digestive system. While some of the ingredients in Dannon Activia and DanActive yogurts are show to have a posivite effect on the immune system we weren’t able to find any independent clinical studies which show that the Dannon product itself has this effect.

 

DanActive Yogurt DrinkThat’s why these types of class action lawsuits are getting settled. Unless you have performed an independent, heavily verified, clinical study it’s typically unlawful to claim that your product helps your body in a specific way. In addition, if you are going to make these claims, often times they need to be approved by the FDA. While the claims may help sales they tend to mislead the consumer buying the product.     I agree with Diana and NOTWHOUTHINK… I’m allergic to milk. Does that mean that Activia is good for me? No. These people who are getting sick, it’s probably not the Activia, it’s probably the milk. They are probably allergic and don’t even know it. And if it’s making you sick…STOP EATING IT!!! People are getting way too sue happy and I agree with Diana… there are way too many who are playing the blame game and can’t take personal responsibility. So if you take something else and you get sick, will you sue them too? I mean c’mon, this is just getting ridiculous. We are hurting our country and I think that a lot of people sit around and wait to see who they can sue next. And what is this lawsuit about anyway? So you got lied to? So what? I’d like to meet one person who is involved with this lawsuit who hasn’t lied at one time or another in their own life. Those people who have never lied at all should be the ones involved in this lawsuit. Just saying. :

    Diana, when the company stops making the claims and pays $35 million back to customers, as here, the case isn’t frivolous, at least legally. The fact that you may not like lawsuits, or may think corporations should be able to advertise unproven or knowingly false health claims to make more money, is something else.

    I also bought and ate this stuff for a month or more with no positive results. Unfortunately, I don’t remember how much I paid or how many servings I bought. So no $ return for me.

    I, too, agree with what Nutritionist07 and NotWhoUTHINK stated. I feel people today do not want to be accountable. They want someone to blame. If a product does not agree with you, then don’t take it. I tried Dannon Activia and it worked for me also tasted good, but some of my friends say it didn’t work for them.
    I am getting tired of these frivilous lawsuits. The only ones winning here are the lawyers. The prices then skyrocket. We, as a country, are hurting ourselves. Now I’m not saying that there shouldn’t be lawsuits, but most of what I read should have never made it to court.
    No two bodies are the same. What works for one may not work for another. My mother had taken Baycol. When we realized what was going on with her, we told her not to take it and contacted her doctor. Her friend was on it and it worked for her.
    I know some may agree with me, and some may not. That’s your right.
    I just wished people would be more responsible.

    Doctor put me on Activia for my problems. Have had great success with this product. Don’t have to take Metamucil anymore. Just wish I could get the Activia with cereal in it again. Can’t find it anywhere, it was so good. Love Activia.

    Found this info. interesting. I bought Dannon weekly beleiving the hipe and when drinkable were out there, I thought Wow! convenience and eating something good for me. So on my weekly shopping added the drinkables to my list. Since then I have purchase a juicing system and I Love it. My new motto ” live food for my live body”.

    I think there are too many people in this world that are anxious to sue a large company/individual over anything they can think of. Fraud, sexual harassment, etc etc……
    Dannon did make a big mistake in this circumstance and does need to take responsibilty. It seems as though when one act can be proven everyone gets over zealous and starts imagining things and saying stupid things like ” This yogurt even goes bad before the expiration date.” Really people? Don’t you have cable TV in that single wide trailer of yours to keep you entertained?
    Stupid people make the original and legitamate complaint look fraudualent and equally insane. Dannon is sued by all kinds of whacko’s for a million different reasons and for millions of dollars. I find it interesting how the ignorant seem to be the most determined whenever money is a motive.
