VGW Malta Ltd., owner of Chumba Casino and Luckyland Slots, has agreed to pay $11.75 million to end a class action lawsuit claiming the company violated Kentucky gambling laws by selling virtual coins in Luckyland and Chumba Casino slots games.

Class members include all Kentucky residents who spent $5 or more at Chumba Casino or Luckyland Slots within a 24-hour period between March 17, 2017, and March 17, 2022.

Plaintiff Amy Jo Armstead filed the Chumba Casino and Lucklyand Slots class action lawsuit Sept. 7, 2022. Armstead states she played Chumba Casino and Luckyland Slots games, and lost more than $7,000 doing so. In her lawsuit, she argues she and many other people were harmed because VGW Malta violated Kentucky gambling laws designed to protect individuals.

She explains VGW Malta owns and operates virtual casino games through the brands Chumba Casino and Luckyland. Allegedly, the virtual games allow players to use virtual coins to play slot games.

The plaintiff states that while first-time players are given these virtual “gold coins” for free, after the initial play, consumers must pay real money to purchase these coins. Consumers can also reportedly place wagers to win more gold coins.

While the company lures players in with its “free to play” model, the games quickly charge players, according to the plaintiff, meaning they fall under the regulations of Kentucky gambling law.

She asserts that as games of chance are illegal in Kentucky, if gambling players lose money at games of chance in the state, they are entitled to receive their lost money within a certain timeframe. In her Chumba Casino and Luckyland Slots class action lawsuit, Armstead requested that the money she lost at gambling, and the money other similarly affected consumers lost, be returned to them.

VGW Malta has not admitted wrongdoing in response to the claims surrounding the games but has agreed to a settlement to avoid the costs and risks of continued litigation.

Class members will be eligible for a proportional payment of the settlement amount, allocated based on how much money they lost from the settlement. These amounts will be determined after attorney fees and costs as well as class representative payments have been allocated.

A payment estimator is available on the settlement website.

Class members who wish to object to or exclude themselves from the VGW Malta Chumba Casino and Luckyland Slots class action lawsuit settlement must do so by Dec. 15, 2022.

A final fairness hearing is scheduled for Jan. 9, 2023.

To receive class action settlement benefits, class members must file a valid claim by March 6, 2023.

  1. a patron says:

Okay 2 things i have to say — for the people who are bashing others for not admitting it was gambling you asserting that is just as lame as those people asserting they didnt know. More so there are REAL CASES of people being the fall person for their elaborate schemes which these reps are suppose to protect players not mislead them. After all if one side has a advantage over the other, then its not gambling anymore…….. I was a patron at a casino which destroyed my life and took funds they should not of done so from a trust for one, then issued 6k in free play when it should of been 10000x that amount. They violated aml bsa and other regulations and then issued a 1099 for 10.2 million which the IRS sees as valid and i owe taxes on something that never left the casino nor did i have. These stotres here are tame compared to mine or the victims who cannot speak anymore such as the elderly who they target … ive been trying to sue for YEARS and cannot afford a firm to pick this up despite it being more the creditable with evidence and witness statements. Contingency on this specialized matter is not possible and will eventually kill me from the burden i carry…. Gambling should only be done in Vegas and ban all Indian casinos. IF firm sees this and wants to really help and set a wrong done to me right… then this would be it. This is a very short summary which doesnt do it any justice….

  2. Sally Parker says:

I live in ca. and Chumba Casino took so much money from me [Daily] with no wins, and very rarely if I did win a good amount it would take it all back without paying on any spins

  5. Megann Davis says:

Your exactly right! Couldnt have said it any better. Everyone here seriously needs to grow up, accept they have a gambling problem and get help. Not sit around whining about their irresponsible financial decisions. It’s honestly ridiculous. And for those people who are saying anyone disagreeing with this dumb lawsuit is probably ‘working for these casino’s just stop. Retain some dignity and lick your wounds privately.

    1. Matt says:

I think it’s more about them not paying out on winnings and unfair play with the way games are setup.

  6. Manda woods says:

Add me from arkansas… i spent over $10,000 in luckyland after getting lured in by thier 5 dollars free gold coins offer. They cheat!!! They take advantage of peoples weaknesses and its not fair.

  7. Horked in Minnesota says:

These turkey hunters have been horking The flailed out turkeys of this nation with their computer wizardry and false and misleading information for far too long now. If I could just go back to picking my face and my substance induced psychosis without getting bothered by the lure of a company who is clearly violating and side stepping typical gambling regulations I would be just fine. How dare these electronic game pimps continue to hork us like this is beyond me. Please help because once this is over I’m going after the men that appear shadowy behind objects that have been stalking me since the last time I went to bed last month. If you’re reading this shadow men I’m going to get you and I won’t stop until the foil falls off my head and I have picked holes through my entire face. From foil to flail stay classy San Diego.

    1. Matt says:

Did you ever find those shadow people? Probably should lay off what is typically put in soft drinks. (Ice) !

  8. Eric says:

I’m from Indiana and I lost thousands of dollars playing and never won a cent I fell like I was robbed

    1. William says:

I’m from south Carolina been saying there crooks for years lost 50 thousand

  9. Kim Thompson-Tesori says:

Yes please add California because Fortune Slots Casino didn’t pay me out when I won.

  10. Leda Smith says:

I requested a withdrawal. Shortly after the request it was approved. I was directed to submit all my information. Just to be informed that I was not able to withdrawal. Customer Service was everything but that !! It was all star slots.
