VGW Malta Ltd., owner of Chumba Casino and Luckyland Slots, has agreed to pay $11.75 million to end a class action lawsuit claiming the company violated Kentucky gambling laws by selling virtual coins in Luckyland and Chumba Casino slots games. 

Class members include all Kentucky residents who spent $5 or more at Chumba Casino or Luckyland Slots within a 24-hour period between March 17, 2017, and March 17, 2022.

Plaintiff Amy Jo Armstead filed the Chumba Casino and Lucklyand Slots class action lawsuit Sept. 7, 2022. Armstead states she played Chumba Casino and Luckyland Slots games, and lost more than $7,000 doing so. In her lawsuit, she argues she and many other people were harmed because VGW Malta violated Kentucky gambling laws designed to protect individuals.

She explains VGW Malta owns and operates virtual casino games through the brands Chumba Casino and Luckyland. Allegedly, the virtual games allow players to use virtual coins to play slot games. 

The plaintiff states that while first-time players are given these virtual “gold coins” for free, after the initial play, consumers must pay real money to purchase these coins. Consumers can also reportedly place wagers to win more gold coins. 

While the company lures players in with its “free to play” model, the games quickly charge players, according to the plaintiff, meaning they fall under the regulations of Kentucky gambling law. 

She asserts that as games of chance are illegal in Kentucky, if gambling players lose money at games of chance in the state, they are entitled to receive their lost money within a certain timeframe. In her Chumba Casino and Luckyland Slots class action lawsuit, Armstead requested that the money she lost at gambling, and the money other similarly affected consumers lost, be returned to them.

VGW Malta has not admitted wrongdoing in response to the claims surrounding the games but has agreed to a settlement to avoid the costs and risks of continued litigation. 

Class members will be eligible for a proportional payment of the settlement amount, allocated based on how much money they lost from the settlement. These amounts will be determined after attorney fees and costs as well as class representative payments have been allocated.

Class members who wish to object to or exclude themselves from the VGW Malta Chumba Casino and Luckyland Slots class action lawsuit settlement must do so by Dec. 15, 2022.

A final fairness hearing is scheduled for Jan. 9, 2023.

To receive class action settlement benefits, class members must file a valid claim by March 6, 2023.

    OMG, This is absolutely ridiculous these people all knew that they were gambling there money and Chumba is in Australia so you should be playing by those rules or some kind of international rules I’d place my bet on the real fact being this chick lost her entire savings because she has a gambling addiction and now wants it back do she looked fir the most ridiculous way to do that and she looks like an idiot this is ridiculous grow up no one made you gamble your money you did now you cry “Whoa is me” pathetic! I HOPE SHE LOSES MORE MONEY IN THUS LAW SUIT CHUMBA SHOULD SUE HER FOR BEING DUMB!

    I’ve played chumba for a long time and I lose and win money and have never had any problems with chumba or luckyland. They have always paid me and if you lose money playing, then that is your fault. It’s your choice to pay and play. They never took money from my accounts. The only way they get money from me is if I choose to buy credits. I’ve lost over a $1000 before, which was my choice. I also have won well over $1000 and never had a problem receiving it. Gambling is a choice. I don’t understand how people in Kentucky can have this lawsuit? Does Kentucky have lottery there? Same thing, no guarantee that you win

      AMEN! You’re exactly right. You know what the craziest thing is? We DO have lottery but we also have casinos scattered throughout the state. I usually go to one of the two that are closest to me about an hour away. And I don’t know of you’ve seen these new “gaming” machines around that are essentially just slot machines. They offer ten or more games to play. My town has them scattered throughout it. You put your money in, push the buttons, and hope for the best. If you’re lucky enough to win, you hit cashout and the machine prints a ticket that is redeemed by the cashier. Is that not gambling? Playing a game of chance? Seems to be some kind of double standard with the laws.

    I also feel as if I have been taking advantage of and I have money taken out of my account without my permission unauthorized withdrawals I would wake up to in the morning time for withdraw a deposit that was made the night before when I never played the game. Chumba block me for years after my initial winnings was not cashed out I was blocked then it was eventually unblocked but while it was blocked and I could not even access my account there was money being taken out of my bank going to chumba but I couldn’t even log in. LL has also made unauthorized withdrawals from my account multiple withdrawals when there was only been one thousands of dollars was taken

    What? You didn’t realize you were spending money and gambling? You went to the site freely, you spent your money aka Sweeps Coins freely, as well as the thousands of FREE coins that you receive with every purchase and after every four hours, and NOW, because I’m assuming you didn’t win whatever you thought you were entitled to, you want to cry foul and say THEY broke the law in KY?!? Force them into a class action lawsuit because you don’t have the sense to walk away? Jeez, I hope you people never discover drugs! Everyone wants to run to the courts and try to get their money back? Well, boo hoo, people. You do know you ALSO broke the law when you decided to play (gamble), and you continued to play and lose to the tune of 7 grand. Get some self control and some pride. Move on. You lost. I think this whole thing is sleazy. I’m curious to know if this would be happening if you had WON. I don’t think so. You’re not entitled to anything and this kind of crap is why this country is in the shape its in. Maybe LL and Chumba have found a nifty way around this actually being gambling, per se, by calling this sweepstakes coins and all that, but players know exactly what they’re doing when they visit these sites. And if you don’t then that’s on you. They’re called games of chance for a reason. Guess this lady thinks that she has better odds at extortion! Well, I for one, will not reduce myself to this level and ask for a handout. And that right there already makes me a jackpot winner. And one more thing… what exactly was she trying to accomplish with those free coins? They’re not good for anything but free play! Another opportunist looking for a payday. Shame, shame.

      I think they should be honest and call it gambling so they would be held accountable as every other gambling agency has to. This way they have to adhere to the guidelines set out to gambling agencies

      Am from California and I would never get the reward money bonuses Etc I had several accounts because I was always shut down or blocked to get back in the games was very exciting and fun so it really leads you on so am I included just as well or could I include myself and I definitely have the emails too a showproof?

    The same is true in South Carolina. I know that this class action is for residents of Kentucky, my situation is the same as this plaintiff, can I join this action or do I need to start one of my own for residents of SC.

      For real chumba casino wouldn’t give me my winnings of 3500. When I tried to withdraw it, they said I violated their terms and blocked my account. I live in sc too.
