Who Qualifies: The Class in this class action lawsuit settlement is made up of cardholders who hold the 1 million unique credit or debit card numbers, whose EMV debit or credit card was used to make a purchase at a payment terminal at a Cheesecake Factory owned, operated, or branded restaurant that was programmed to print the first six and last four card numbers on customers’ receipts between Nov. 10, 2016, and Feb. 4, 2017. (NOTE: Not all Cheesecake Factory locations printed receipts such as these, and therefore, not everyone who received a printed receipt between those dates is considered a Class Member.)

The Cheesecake Factory Inc. will pay $4.75 million to resolve class action lawsuit claims it violated the Fair and Accurate Credit Transactions Act (FACTA) by displaying more information than legally allowed on its receipts.
The Class is made up of cardholders who hold the 1 million unique credit or debit card numbers, whose EMV debit or credit card was used to make a purchase at a payment terminal at a Cheesecake Factory owned, operated, or branded restaurant that was programmed to print the first six and last four card numbers on customers’ receipts between Nov. 10, 2016, and Feb. 4, 2017.Â
Not all Cheesecake Factory locations printed receipts such as these, and therefore, not everyone who received a printed receipt between those dates is considered a Class Member.
Plaintiffs in a class action lawsuit alleged Cheesecake Factory violated FACTA by printing point-of-sale receipts that displayed more than the first six and last four digits of the customer’s credit card number at select locations.
Class Members in the Cheesecake Factory settlement will receive a pro rata portion of the settlement fund.Â
In order to receive a payment, Class Members must submit a claim form using their Class ID number and will be required to upload copies of the relevant receipts or documentation of the date each receipt was provided.
Those who do not have a Class ID number must submit a Publication Claim Form by mail and provide each covered receipt or the date or dates when each such receipt was provided, as well as the store location, according to the settlement notice.
The payment amount will depend on the number of claim forms that are submitted. Class Counsel estimates the payments will be between $28 and $56, based on a claim rate of 5 percent to 10 percent.
The final approval hearing in the Cheesecake Factory receipt settlement is set for May 6, 2022.
The deadline to opt out of or object to the settlement is March 31, 2022.
The deadline to submit a claim in the Cheesecake Factory settlement is also March 31, 2022.

To comb through my credit card transaction history though. And how would people even receive a claim ID when you swipe your card it’s not associated with an email address.
The claim ID would arrive in your regular mail box at your house, or the address your credit card is associated with.

How can we keep a receipt from 2016???? What a joke! I dined at the restaurant around that time but I don’t even keep my receipts from last week! How are we supposed to keep receipts from 6 years ago? Are you kidding me?! I think attorneys want to get all settlement money to themselves, that’s why they make it impossible for us to file claim. We know what you’re doing. Don’t think you’re the smarter one.
