Old Navy agreed to a reference pricing class action settlement to resolve allegations it used misleading sale advertisements to dupe customers — and no proof of purchase is required with the claim form in order to benefit.
The settlement benefits consumers who made in store or online purchases from Old Navy or Old Navy outlet stores between Nov. 12, 2015, and Dec. 2, 2021. The Class includes all states except Missouri.
Eligible shoppers may have received a settlement notice and claim form in the mail if their contact information was available.
However, even those who did not receive a settlement notice directly can still file a claim form on the settlement website.
Old Navy is a well-known clothing retailer owned by Gap Inc. According to the company’s website, there are over 1,200 locations around the country.
However, shoppers at these locations may have been duped by false sale advertisements, according to a reference pricing class action lawsuit against Old Navy.
Plaintiffs in the Old Navy class action lawsuit claimed that the clothing retailer intentionally misrepresented its sales in order to mislead consumers. Old Navy allegedly advertised some products as “on sale” with a referenced “regular” list price. However, despite this labeling, the “sale” items were allegedly never sold at the false reference price.
Due to this reference pricing, consumers say they were misled into believing they were getting a good deal — making them more likely to make a purchase.
Without a false reference price, consumers say, they would have saved money by making fewer purchases.
Old Navy has not admitted any wrongdoing but agreed to resolve the reference pricing class action lawsuit with a settlement deal.
Under the Old Navy false sale class action lawsuit, Class Members can receive settlement purchase certificates worth $5.
The number of certificates awarded to each customer will depend on their purchase history and any proof provided.
Tier 1 claimants will receive one Old Navy settlement purchase certificate if they either did not provide proof of purchase or submitted proof with their claim form for less than $90 in qualifying purchases.
Tier 2 claimants who submit proof with their claim form for more than $90 in qualifying purchases can receive two Old Navy settlement purchase certificates.
The deadline for exclusion and objection is Feb. 16, 2022.
The final approval hearing for the Old Navy sale settlement is scheduled for March 16, 2022.
In order to receive Old Navy settlement purchase certificates, Class Members must complete and submit a valid claim form by May 31, 2022.
Who’s Eligible
All United States citizens who made one or more purchases in-store at an Old Navy Store or Old Navy Outlet Store in the United States, excluding purchases made while in Missouri, or online from the Old Navy website between Nov. 12, 2015, and Dec. 2, 2021.
Potential Award
Settlement Purchase Certificates.
- Tier 1 claimants — Those who do not submit proof of qualifying purchase(s) or who submit proof of qualifying purchase(s) that are less than $90 with his or her timely and valid claim form will receive a Settlement Purchase Certificate for $5 for any purchase or off any purchase (no minimum purchase required).
- Tier 2 claimants — Those who had qualifying purchase(s) totaling $90 or more during the Class Period and submit proof of such purchase(s) with their timely and valid claim form will receive two Settlement Purchase Certificates for a total value of $10 for any purchase or off any purchase (no minimum purchase required).
Proof of Purchase
No proof of purchase is required for Tier 1 claimants.
Tier 2 claimants must submit either receipt(s) clearly showing the date of purchase(s) and the total of the purchase(s), or a credit or debit card transaction record that clearly shows the purchase date and purchase total.
