Chase Bank has agreed to pay $11.5 million to settle a class action lawsuit alleging the bank harmed credit card accountholders’ credit scores and even required them to pay on debts that were discharged in Chapter 7 bankruptcy.

The Chase credit card class action lawsuit alleged that the debts on Class Members’ accounts that were discharged in bankruptcy were sold to third parties, known as debt buyers; however, Chase failed to update accountholders’ credit reports. Instead, the credit reports reflected that the debts were sold or charged off.

The class action lawsuit claimed that Chase’s failure to update these credit card accounts reflected negatively on Class Members’ credit scores. Further, some Class Members, concerned about the affects of the allegedly falsely reported debt on their credit score, continued to pay on debts that had been discharged in bankruptcy.

Chase Bank says it did not attempt to collect on discharged debts, but has agreed to pay $11.5 million to end the class action lawsuit.

Class Members may be entitled to a full refund of any amount they paid on a Chase Bank credit card debt that was discharged in Chapter 7 bankruptcy, along with a portion of the settlement award.

The deadline to opt out of the class action settlement agreement is July 18, 2018.

Who’s Eligible

Class Members include “all individuals (i) who maintained a Credit Card Account with CBUSA; (ii) whose account CBUSA charged off and then sold to a Debt Buyer on or after January 1, 2008, and (iii) who post-sale sought and obtained a discharge of the debt as a result of his/her bankruptcy under Chapter 7 of the Bankruptcy Code, through and including the date of the Bankruptcy Court’s preliminary approval of the Settlement.”

Potential Award

A full refund of the amount paid on an affected Chase Bank credit card account, along with a share of the settlement award.

Proof of Purchase

    Chase bank in 2008 claimed I paid late and decreased my credit limit to the amount owed. I did not pay late but this action by chase damaged my credit score by a whopping 100 points. Then, my mother had EXACTLY the same thing happen to her chase credit, chase claimed she was late, dropped credit line, fico lowered by action. I fixed both but it took months

      Request the information through freedom of information Act from chase in writing sent registered mail. Request information on the card from one of the credit bureaus covering the time periods you need. If you paid from your bank account. Request them to research the account information. There is a charge for the bank information but if you paid thousands of dollars then it will pay off. The banks keep 7-10 years of information at least.

        The Freedom of Information Act (FOIA) is a federal law that applies to federal government agencies only. It does not apply to a non-governmental company or corporation such as Chase.

    I do not understand why anyone thinks typing “Add Me” in the comments is going to do anything. Read the instructions! If you did not file Chapter 7 Bankruptcy you are not eligible to be part of the settlement. Simply having a Chase card means nothing.
