Consumers who purchased Charmin Freshmates Flushable Wipes in the past seven years, could get cash from a class action settlement.
Several consumers lodged class action lawsuits against Procter & Gamble alleging their wet wipe type toilet product, Charmin Freshmates, caused clogs and other plumbing problems.
The plaintiffs contended that the product was falsely advertised as being “flushable” and “septic safe,” but led to major toilet issues and, for some, expensive plumbing bills.
The Charmin Freshmates class action states that the flushable wipes have never been suitable for flushing as they “clog and damage plumbing pipes, fail to properly break down in septic tanks, damage septic pumps, catch on screens in municipal sewage lines and must be removed from the sewer system for disposal in landfills, and damage municipal sewage lines and pumps, often due to the proclivity of the wipes to tangle with each other, tree branches, rocks, and other non-flushable items, and form large masses or ropes.”
In addition, the Charmin class action lawsuit claimed that the tiny disclaimer that informs consumers to only flush one or two wipes at a time is still misleading because the wipes do not break down like toilet paper and therefore cause plumbing damage.
The Charmin flushable wipes class action alleges that consumers are financially injured by a minimum of a few hundred dollars when they have to hire a plumber to unclog sewer lines.
Under the terms of the Charmin flushable wipes class action settlement, those who purchased Charmin Freshmates Flushable Wipes between April 6, 2011 and Nov. 26, 2018 can file a claim.
Class Members who can submit proof of purchase can receive a payout of up to $30. Those without proof of purchase can claim up to seven purchases. Class Members will receive a payout of $.60 per package.
Class Members include consumers nationwide, except for those in New York.
Procter & Gamble as also agreed to make labeling changes per the Charmin flushable wipes class action settlement, along with paying $2.15 million in attorneys’ fees and between $1,000 and $5,000 in plaintiffs’ awards.
The deadline to file a claim is Feb. 28, 2019. Class Members who want to object to or exclude themselves from the class action settlement must do so by the same date.
The final hearing is scheduled for March 28, 2019.
Who’s Eligible
Class Members include those who purchased Charmin Freshmates Flushable Wipes or any other Charmin pre-moistened wipes that said it was “flushable” on the package label between April 6, 2011 and Nov. 26, 2018. The products must not have been purchased in the state of New York, however.
Potential Award
Up to $30.
Proof of Purchase
Proof of purchase is not required, but Class Members can only receive a cash payout for up to seven purchases without proof. Class Members who provide proof of purchase can claim up to 50 purchases.
