Consumers have secured a settlement in a class action lawsuit alleging Charmin’s so-called flushable wipes are not as plumbing friendly as advertised.

A number of class action lawsuits were filed against the makers of Charmin Flushable Wipes, Procter & Gamble.

The plaintiffs allege that although the product is advertised as “flushable,” as well as safe for septic systems, the wipes are not actually suitable for flushing down a toilet.

The Charmin Flushable Wipes class action lawsuit claims that the wipes routinely damage plumbing and septic systems, leading to expensive repairs.

Although Procter & Gamble continue to maintain that Charmin Flushable Wipes perform as advertised, they have agreed to pay a Class of consumers who purchased the product to settle the class action lawsuit. The company has also agreed to pay the plaintiffs’ attorneys $2.15 million in fees.

Under the terms of the Charmin Flushable Wipes class action settlement, Class Members can receive $.60 per package purchased. Up to seven packages can be claimed without proof of purchase and up to 50 packages can be claimed for Class Members who can provide proof of purchase.

“Plaintiffs and Plaintiffs’ Counsel believe that a refund to class members of $0.60 per package is an excellent result and at least as good or better than the likely recovery at trial,” notes the motion for preliminary approval of the Procter & Gamble class action settlement.

“The average price per package sold was $4.01, and thus, at trial, consumers would likely not receive more than 34 cents per package in restitution. The settlement payment of $0.60 per package is approximately 175% of the best-case recovery on a per-package basis.”

Class Members include consumers nationwide, with the exception of New York residents, who purchased Charmin Freshmates Flushable Wipes between April 6, 2011 and Aug. 3, 2017.

Proof of purchase can be submitted online or by mail. It can include receipts for up to 50 packages of Charmin Flushable Wipes.

Notice of the Charmin Flushable Wipes class action settlement will be published in several magazines as well as online.

“P&G has also agreed to be subject to a two-year injunction further modifying the marketing of the Product and setting forth testing protocols with which the Product must comply,” points out the plaintiffs’ motion for preliminary approval of the Charmin Flushable Wipes class action settlement.

A number of Charmin Flushable Wipes class action lawsuits were filed against Procter & Gamble over the allegedly toilet clogging product.

Several lawsuits were whittled away during litigation, but two were certified, while a third proceeded in California. The claims in three of the class actions are included in this recent settlement.

The Procter & Gamble Flushable Wipes Class Action Lawsuit is Pettit v. Procter & Gamble Co., Case No. 3:15-cv-02150, in the U.S. District Court for the Northern District of California.

The certified Flushable Wipes Class Action Lawsuits are Belfiore v. The Procter & Gamble Co., Case No. 2:14-cv-04090, and Kurtz v. Kimberly-Clark Corp., et al., Case No. 1:14-cv-01142, in the U.S. District Court for the Eastern District of New York.
