Capital One class action lawsuit

If you received a non-emergency telephone call on your cell phone from Capital One Financial Corp. (or from another company on behalf of Capital One) through the use of an automatic telephone dialing system or an artificial or prerecorded voice in connection with an attempt to collect on a credit card debt, you may be eligible for benefits from a Capital One TCPA class action settlement.

The proposed settlement would resolve a class action lawsuit that alleges Capital One violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system and/or an artificial prerecorded voice to call cell phones without the prior express consent of the recipients.

The defendants deny the allegations but agreed to settle the TCPA class action lawsuit to avoid the risk and uncertainty of litigation. Under the terms of the class action settlement, Capital One, Leading Edge Recovery Solutions LLC, Capital Management Services LLP and AllianceOne Receivables Management Inc. will pay more than $75 million into a settlement fund for eligible Class Members.

Who’s Eligible

Class Members of the TCPA class action settlement include consumers who received (1) an automated call from Capital One between Jan. 18, 2008 and June 30, 2014 regarding a Capital One credit card account, or (2) an automated call from AllianceOne Receivables Management Inc., Capital Management Systems LP, and/or Leading Edge Recovery Solutions LLC between Feb. 28, 2009 and June 30, 2014 regarding a Capital One credit card account.

Potential Award

$20-$40, depending on how many claims are filed.

Proof of Purchase

Class Members must provide the cell phone number at which they received the automated Capital One debt collection calls.

    I got talked out of submitting my claim by my mom bc she thought I shouldn’t get tied up in any lawsuits..stupid me! I shoulda done my research bc I clda used a lil extra cash! I realize this is old news but I just found my post card from the settlement going thru old papers and decided to look into it and see how much I missed out on. I hate that so many ppl seem to have been scammed outta getn what u should have! I was going to take a pic of the post card but just realized there’s no place to add one..Anyway, I hope they get u guys straightened out with ur settlement payment!

    they sent my check so late i got it after the expiration date of feb 3 2016. I wrote them a note explaining this i have not heard fom them at all!!!! I never got paid. I think im going to take them to small claims here in ny just so they have to come up here if they dont want to give me my check they can pay a few hundred in travel costs to answer my suit! I dont know what else to do! Can they legally keep my settlement money?????

    I received a check for $4.69 (in New Mexico-yes, we are part of the United States :) ) I was surprised that this was the second check, because I never did receive the first check. I did file the claim on time and was not expecting a check for a while, since i thought it would take a while for the settlement to be final. However, I did notice my name on the check was misspelled. I called the number provided on the capitalonetcpaclasssettlement.com website, but it is just a recording-with no option to speak with a human. So I guess I am out of luck-someone else probably cashed the first check fraudulently.

    I never received my check and i dont know if some one stolen it from the mail because we have problems with people stealing our mail where i love so i ordered a 2nd check and still i received no check ive been in the lawsuit since the beginning so i know i should have received one please help me some one
