Capital One class action lawsuit

If you received a non-emergency telephone call on your cell phone from Capital One Financial Corp. (or from another company on behalf of Capital One) through the use of an automatic telephone dialing system or an artificial or prerecorded voice in connection with an attempt to collect on a credit card debt, you may be eligible for benefits from a Capital One TCPA class action settlement.

The proposed settlement would resolve a class action lawsuit that alleges Capital One violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system and/or an artificial prerecorded voice to call cell phones without the prior express consent of the recipients.

The defendants deny the allegations but agreed to settle the TCPA class action lawsuit to avoid the risk and uncertainty of litigation. Under the terms of the class action settlement, Capital One, Leading Edge Recovery Solutions LLC, Capital Management Services LLP and AllianceOne Receivables Management Inc. will pay more than $75 million into a settlement fund for eligible Class Members.

Who’s Eligible

Class Members of the TCPA class action settlement include consumers who received (1) an automated call from Capital One between Jan. 18, 2008 and June 30, 2014 regarding a Capital One credit card account, or (2) an automated call from AllianceOne Receivables Management Inc., Capital Management Systems LP, and/or Leading Edge Recovery Solutions LLC between Feb. 28, 2009 and June 30, 2014 regarding a Capital One credit card account.

Potential Award

$20-$40, depending on how many claims are filed.

Proof of Purchase

Class Members must provide the cell phone number at which they received the automated Capital One debt collection calls.

    Amy the very same thing happened to me exactly !! what my bank they told me they could not verify their account it took me threatening Capital One with fraud and order them through applied and they told me I could not be found in their database even when I emailed, mailed them a copy of the check they sent me! It is unlikely you will not get your money unless you contact the BBB, FBI whoever deals with fraud let the them deal with them okay I’ll copy
    you last email they sent , me okay I got you girl the number I was contacted from is 503 – 350- 5800 its Central time (Organ) contact your bank take copies of the emails that they have and plus any comments from me and is another lady named Jackie print them out and take them to your bank let them know they will not issue you re submit you a new check no matter what report them to the Better Business Bureau as well as contact the FBI for possible fraud you may not or may get your money back then we can we stop people this needs to be addressed getting shorted is no joke and the possibility of being sued that will get thier attention to , live in MD too.

    Got my check for $39.10 here in MD – deposited the check and the check was returned and I got charged a $12.50 fee by my bank for a returned deposit. So not only and I out the $39.10, I am also in the whole for $12.50. I AM NOT HAPPY AT ALL!!!

    Have not received a check. Tried to go online and they are stating that my notice id number is invalid. But I know I submitted a claim. Anyone else experiencing this problem?
