Capital One class action lawsuit

If you received a non-emergency telephone call on your cell phone from Capital One Financial Corp. (or from another company on behalf of Capital One) through the use of an automatic telephone dialing system or an artificial or prerecorded voice in connection with an attempt to collect on a credit card debt, you may be eligible for benefits from a Capital One TCPA class action settlement.

The proposed settlement would resolve a class action lawsuit that alleges Capital One violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system and/or an artificial prerecorded voice to call cell phones without the prior express consent of the recipients.

The defendants deny the allegations but agreed to settle the TCPA class action lawsuit to avoid the risk and uncertainty of litigation. Under the terms of the class action settlement, Capital One, Leading Edge Recovery Solutions LLC, Capital Management Services LLP and AllianceOne Receivables Management Inc. will pay more than $75 million into a settlement fund for eligible Class Members.

Who’s Eligible

Class Members of the TCPA class action settlement include consumers who received (1) an automated call from Capital One between Jan. 18, 2008 and June 30, 2014 regarding a Capital One credit card account, or (2) an automated call from AllianceOne Receivables Management Inc., Capital Management Systems LP, and/or Leading Edge Recovery Solutions LLC between Feb. 28, 2009 and June 30, 2014 regarding a Capital One credit card account.

Potential Award

$20-$40, depending on how many claims are filed.

Proof of Purchase

Class Members must provide the cell phone number at which they received the automated Capital One debt collection calls.

    My problem isn’t as much all about i got calls from them. Mine is the fact that after calling them to get the payoff amount and paying them off for the balance they quoted to me and the company that paid them off. They still sent me bills and harassing phone calls and placed it on my credit report saying i still owed them money. What the hell!still to this day they send bills.

    They sent out postcards to the people they actually called, so they have records of the actual numbers.

    How is it fair to stand up as the injured party with maybe a gain of 20 – 40 dollars when a team of Lawsuit happy lawyers stand to gain 100s of thousands of dollars. when will the injured party gain the majority of money and stop lawyers from being driven to law suits only for personal monetary gains. How about fighting for whats right. how about awarding people 10,000.00 and the attorneys fee be 10% ?? just sayin

      this is very true , they are gaining the money for there benefits not the people that they are to fight for, it is why the problem we have is going on. I believe there is to be 10,000 given to the people each that is involved, so that is the law, of the land , oh or what is fair, justify, what is the Justice with this.

    Who is the class action administration or check processing clearing house? I hate when they don’t include that information. Examples of names are RUST, CGC, Dahl. Some clearing houses tend to send everyone rejection letters so I don’t want to waste my time filling out an application only to get a denial letter.
