California P.F. Chang’s customers have secured a $1 million class action settlement resolving claims that the restaurant chain violated state laws by soliciting personal information on credit card transaction forms.
Class Members include those who used a credit card at a California P.F. Chang’s location between May 3, 2016 and Feb. 22, 2019.
According to the P.F. Chang’s class action lawsuit, the restaurant chain provided a form to all patrons who used a credit card to pay for their purchase that contained spaces for their phone numbers and email addresses.
P.F. Chang’s allegedly violated California law, specifically the Song-Beverly Credit Card Act. Merchants in California are barred from collecting personal identification information from consumers who use credit cards at their establishments under the Act.
The plaintiffs said that despite this provision, California P.F. Chang’s restaurants solicited the phone numbers and email addresses from customers who used credit cards.
P.F. Chang’s continues to deny the class action lawsuit allegations, but has agreed to redesign its credit card forms to ensure compliance with California law.
The restaurant has also agreed to pay up to $1,000 to each Class Member. The amount each Class Member receives depends on the total number of valid claims submitted.
To submit a claim, Class Members must provide a Claim ID provided on the settlement Notice. Class Members who do not have their Notice will need to provide the approximate date and location of their P.F. Chang’s purchase, along with the type of credit card they used and the last four digits of the card number.
The deadline to object to or opt out of the California P.F. Chang’s restaurant class action settlement is June 7, 2019.
Who’s Eligible
Class Members include “all persons who engaged in a credit card transaction at a California P.F. Chang’s Restaurant during the Class Period, during which Defendant provided a Credit Card Transaction Form that contained a space that allowed the credit cardholder to fill in his or her personal identification information.” The Class Period occurred between May 3, 2016 until Feb. 22, 2019.

Up to $1,000.

Claim ID or the approximate date and location of the purchase along with the last four digits and type of credit card used for the transaction.

This is a class action on behalf of all persons who used a credit card with defendant P.F. Chang’s China Bistro, Inc. in California from May 3, 2016 to February 22, 2019, for which defendant used a form that contained preprinted spaces designated for filling in the cardholder’s telephone number or email address. The class includes approximately 350,000 members.
The Court granted preliminary approval on February 22, 2019. ROA # 65. The general terms of the settlement were discussed in that order and will not be repeated here other than to note that from a gross settlement of $1,000,000, a net settlement amount of approximately $550,000 will be paid pro rata to class members who submit a claim. Of the 353,369 email notices sent to class members, 293,098 were successfully delivered. Keough Decl., ¶¶ 5-6. Notice was also given by a banner ad on Google Display Network which delivered over 4.1 million impressions. Id. at ¶ 9. In addition, a dedicated website established by the claims administrator tracked 21,343 unique visitors. Id. ¶¶ 7-8. Of the 11,699 claims submitted, 10,082 claims were approved. Id. at ¶ 15. Thus, each class member will receive about $55.00.
The pool of funds is $550,000. No information provided on number of approved claimants or amounts provided.

From the administrator’s email last week: Thank you for your email. Per Court order, the Settlement became effective on October 17, 2019, and benefits to eligible class members will be mailed by November 15, 2019.
