Kohl’s Fake Sale Class Action Settlement

Our readers are reportedly receiving $10 gift cards in the mail from a class action settlement resolving allegations that Kohl’s tricked customers into believing they were getting items that were on “sale” by creating an “original” pricing scheme.

The $6 million class action settlement ends claims that the retailer marked items at a discount that were not actually sold at the “original” price three months prior to the purchase date.

Kohl’s customers who filed a valid claim expected to receive an equal portion of the settlement fund by way of a gift card.

The deadline to file a claim for the Kohl’s class action settlement passed on Aug. 9, 2019.

The plaintiffs were represented by Douglas Caiafa of Douglas Caiafa, A Professional Law Corporation and Christopher Morosoff of the Law Office of Christopher J. Morosoff.

The Kohl’s Fake Sale Class Action Settlement is Russell v. Kohl’s Department Stores Inc., et al., Case No. 5:15-cv-01143, in the U.S. District Court for the Central District of California.

P.F. Chang’s Customer Privacy Class Action Settlement

Top Class Actions viewers are also receiving checks in the mail from a P.F. Chang’s class action settlement that ends claims that the Chinese restaurant chain violated California state law by collecting personal information from customers who used a credit card to pay for their meals.

According to the P.F. Chang’s class action, the company asked patrons for their phone numbers and email addresses on credit card receipts in violation of the Song-Beverly Credit Card Act.

P.F. Chang’s denied the allegations but agreed to settle the class action by paying $1 million to Class Members. Our readers report getting checks worth $53.22 from this settlement.

The deadline to file a claim for the P.F. Chang’s class action settlement was June 7, 2019.

The P.F. Chang’s Customer Privacy Class Action is Seegert v. P.F. Chang’s China Bistro Inc., et al., Case No. 37-2017-00016131-CU-MC-CTL, in the Superior Court of California, County of San Diego.

Fingerhut Texts Class Action Settlement

Our readers are getting checks in the mail worth $28.53 from a Fingerhut class action settlement that resolves claims that the company sent unwanted texts to consumers in violation of the Telephone Consumer Protection Act.

According to the Fingerhut class action, the company sent these messages and then flagged the phone numbers as being the “wrong party” on outbound calls between 2012 and 2018.

Fingerhut denied any wrongdoings but agreed to pay $5.25 million to settle the allegations against them.

The deadline to file a claim for the Fingerhut class action settlement passed on Aug. 29, 2019.

The plaintiffs are represented by Ronald Marron, Alexis Wood and Kas Gallucci of The Law Offices of Ronald A. Marron, and by Thomas Lyons Jr. of Consumer Justice Center PA.

The Fingerhut Text Message Class Action is Busch v. Bluestem Brands Inc., Case No. 0:16-cv-00644-WMW-HB, in the U.S. District Court for the District of Minnesota.

Sonic Drive-In Data Breach Class Action Settlement

Top Class Actions viewers are receiving checks in the mail worth up to $129.76 from a Sonic Drive-In data breach class action settlement.

The $4.3 million class action settlement ends allegations that customers who dined at one of 325 Sonic locations in 2017 had their personal information exposed in a data breach brought on by inadequate security measures.

The Sonic class action settlement was set to pay out all customers who used their debit or credit cards at a location affected by the data breach $10, and then those who experienced actual harm due to the security breach $40.

Overall, both payout amounts were higher than projected.

The Claim Form deadline for the Sonic data breach class action settlement passed on April 19, 2019.
