Burlington Coat Factory has agreed to settle a class action lawsuit alleging it violated the law by requesting and recording telephone numbers from customers when they paid with a credit card at a retail store located in California.

If you used a credit card to pay for merchandise at a Burlington Coat Factory store in California and were asked to provide your telephone number at the time of purchase, you may be eligible for benefits from the class action settlement.

The Burlington settlement will resolve a class action lawsuit that accused Burlington of violating California’s Song-Beverly Act by requesting and recording telephone numbers who paid for merchandise with a credit card.

The Burlington class action lawsuit went to trial, and Burlington was found liable for the Song-Beverly Act violations. Burlington denies that it violated the law, but agreed to pay more than $29 million to settle the litigation. The class action settlement was preliminarily approved on Nov. 6, 2015.

Who’s Eligible

Class Members of the Burlington settlement include all individuals from whom Burlington requested and recorded telephone numbers in conjunction with a credit card purchase transaction in its California retail stores between Feb. 14, 2010 and Jan. 28, 2015.

NOTE: If a Burlington employee requested and recorded your telephone number in one of the following situations, you are not entitled to benefits from this class action settlement:

  • You used a credit card issued to a business;
  • Your information was requested in connection with a special order, delivery, cash advance or layaway, tailoring or alterations, installation, tax exempt transactions or gift registry; or
  • The transaction was a return or exchange of purchased merchandise.
Potential Award

$10 cash or a $25 voucher.

Class Members are entitled to receive one of two awards:

1. A Cash Award, which is a voucher redeemable for $10 cash at any Burlington Coat Factory store; or

2. A $25 Merchandise Voucher redeemable for use during any purchase at any Burlington Coat Factory store located in the United States.

Proof of Purchase

Class Members must provide the transaction date and telephone number that was requested and recorded when they made a purchase with their credit card at Burlington between Feb. 14, 2010 and Jan. 28, 2015.

    I got one in mail for my dad, it’s a white post card, guess I’ll take it to store and try it, thought this was something I had to mail in first due to return addressed label attached, after looking closer it says for change of address. So I hope all need is this card, would be a nice change getting something instead of having to give something.

      I emailed the claim administrator the vouchers are being mailed out next week. I don’t think that any of those people have received anything yet. That eggshell should not crack before being fully boiled

    Received my $25.00. I used it at a washington state burlington to purchase 3 shirts. Cashier asked me for my phone number!! I laughed.

    . My question is does the gift certificates deducted from the total which include the taxes. Or should it be deducted before the taxes is added? Thanks

      taxes are included in the 25.00 purchase yes..

    I got my $25 voucher and tried to use it today. Cashier claimed it had already been redeemed?!?! WT#=@? This has to be a SCAM! Now they my info twice and wasted my time!! :-(

    My friend gave me her $25 certificate, can I able to use it? And do I need her or my I’.D. , because in back of the certificate it has her name on it..

      When I used mine the other day they didnt even ask for ID.

    It looks phony to me people. I got one of those $25 cards without nay explanation, instructions or anything. Its a scam on part of lawyers, court, judge, etc. So, you take your card to the store if you can find it. And they give you a $25 credit on a $200 bathing suit. BFD, Thats the deal. Throw it away. It cost you $175 for a marked up $5 item.

      Its not a scam, I got mine yesterday and I used it since I live about 4 blocks from the store. Its real…dont throw it away or give it to me lol…
