Burlington Coat Factory has agreed to settle a class action lawsuit alleging it violated the law by requesting and recording telephone numbers from customers when they paid with a credit card at a retail store located in California.
If you used a credit card to pay for merchandise at a Burlington Coat Factory store in California and were asked to provide your telephone number at the time of purchase, you may be eligible for benefits from the class action settlement.
The Burlington settlement will resolve a class action lawsuit that accused Burlington of violating California’s Song-Beverly Act by requesting and recording telephone numbers who paid for merchandise with a credit card.
The Burlington class action lawsuit went to trial, and Burlington was found liable for the Song-Beverly Act violations. Burlington denies that it violated the law, but agreed to pay more than $29 million to settle the litigation. The class action settlement was preliminarily approved on Nov. 6, 2015.
Who’s Eligible
Class Members of the Burlington settlement include all individuals from whom Burlington requested and recorded telephone numbers in conjunction with a credit card purchase transaction in its California retail stores between Feb. 14, 2010 and Jan. 28, 2015.
NOTE: If a Burlington employee requested and recorded your telephone number in one of the following situations, you are not entitled to benefits from this class action settlement:
- You used a credit card issued to a business;
- Your information was requested in connection with a special order, delivery, cash advance or layaway, tailoring or alterations, installation, tax exempt transactions or gift registry; or
- The transaction was a return or exchange of purchased merchandise.
Potential Award
$10 cash or a $25 voucher.
Class Members are entitled to receive one of two awards:
1. A Cash Award, which is a voucher redeemable for $10 cash at any Burlington Coat Factory store; or
2. A $25 Merchandise Voucher redeemable for use during any purchase at any Burlington Coat Factory store located in the United States.
Proof of Purchase
Class Members must provide the transaction date and telephone number that was requested and recorded when they made a purchase with their credit card at Burlington between Feb. 14, 2010 and Jan. 28, 2015.

I received my 25.00 certificate in the mail today. white small postcard.
I know I should have been a part of this settlement, filed a claim, but have not received anything. My daughter never submitted a claim and she received $25. How did this happen?
This only applies to purchases made in California. If you bought there then you will get your certificate. Its a California law that stores can not ask for telephone numbers. Dont ask why, IDK.. but this class action suit is only in Calif.
I never sent the forms, I meant to call and find out more but never got around to it. Ive never shopped at Burlingtons and the number that was given had been disconnected since 2008, but they still sent my voucher even though I didn’t send anything in because I know there was a mistake made of a whole other type

Well, I shop there quite often and always used my credit card. I had no idea of this class action suit until today when I received a 25.00 merchandise certificate AS I WAS ON MY WAY to this store….what a great surprise…..
Me too, got my $25 voucher, just looked to see if it was real or some scam. I guess it is OK. I do not shop there that often, so I was surprised by the voucher in the mail.

They also ask for it in Maryland.

How about any of the other Burlington Coat Factory stores? They all ask for that info. I worked in BCF and I bought many items from there over the years too and gave my phone no. with a credit and /or debit card. On two different occasions I had to replace my debit card because of transactions there.
I have made several purchases on credit card over the years from Burlington. They asked for a phone no. and the zip code. Who remembers the transaction date. I challenge these attorneys, the Judge and the administrators if they remember the dates every time they buy something. The attorneys are taking away approx close to 9 million and the consumers get 10 or 25. This is ridiculous. We dont want the lawsuit. We did not ask you attorneys. Just go forward with the person whoever came to you. Thankyou very much hungry and greedy atttorneys.
Hello Mayra, It appears you have read the court documents. As you may realize from the documents you still have an opportunity to object to the settlement and/or decline to a part of the class action and pursue a court case on your own. The percentage that the attorneys are receiving are typical of a federal class action of this type.
Who has the time or the money to sue on their own? And I do agree with the above person that we should not have to prove what date we made the purchase…it’s an extra hoop the consumer has to jump through to right their wrong. It would potentially take me months to go through all my credit cards to find the purchases. If we find more than one purchase do we get twice the money? Probably not.
WOW!!! Just thought Id check to see what was going on with that hot 25 dollars and have read everyones reply. Sad Sad Sad and still havent seen a penny. Wow I wont spend my money @ Burlington anymore. Or those Greedy Lawyers
