BetterBody class action settlement

BetterBody Food & Nutrition LLC has agreed to settle a class action lawsuit alleging that some of its coconut oil products were misleadingly marketed as healthy.

If you purchased BetterBody Extra Virgin Coconut Oil or Naturally Refined Coconut Oil between Jan. 1, 2013 and Nov. 18, 2016, you may be entitled to a cash payment and/or gift card from the BetterBody class action settlement.

BetterBody manufactures, distributes and markets BetterBody Extra Virgin Coconut Oil and Naturally Refined Coconut Oil.

The BetterBody class action lawsuit alleges that these coconut oil products were misleadingly marketed as healthy, in violation of California consumer protection statutes.

Specifically, the coconut oil class action lawsuit asserts violations of the Unfair Competition Law, False Advertising Law, Consumers Legal Remedies Act, as well as breach of express and implied warranties.

BetterBody denies the allegations and maintains that it did nothing wrong. However, it has agreed to settle the coconut oil class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

Under the terms of the proposed BetterBody class action settlement, BetterBody will offer a total of $1 million in monetary relief to Class Members.

In addition to providing compensation to Class Members, BetterBody has also agreed to remove the following statements from its Extra Virgin Coconut Oil and Naturally Refined Coconut Oil labels and advertising:

  • “A Healthy Alternative to Butter & Cooking Oil”
  • “One of the healthiest oils in the world”
  • “Zero Transfat”
  • Images of hearts
  • “Full of MCTs, aka good fats, coconut oil is an immediate source of energy”
  • “cholesterol free”

The BetterBody coconut oil class action settlement was preliminarily approved on Nov. 18, 2016.

Class Members who wish to opt out of the BetterBody coconut oil settlement must do so no later than Jan. 20, 2017. If you would like to object to the class action settlement, you must do so by Jan. 30, 2017.

UPDATE: On April 10, 2017, Top Class Actions viewers who filed valid claims for the BetterBody class action settlement are starting to receive gift cards and checks in the mail!

Who’s Eligible

Class Members of the BetterBody settlement include anyone who, between Jan. 1, 2013 and Nov. 18, 2016, purchased BetterBody Organic Extra Virgin Coconut Oil or BetterBody Organic Refined Coconut Oil for personal or household use.

Potential Award

Varies.

A full refund to Class Members who submit proof of purchase, and up to $40 to claimants who do not provide proof of purchase.

Proof of Purchase

Class Members who provide proof of purchase are entitled to a full refund (cash payment) for the BetterBody products they purchased.

Class Members without proof of purchase may make a claim for up to $40. This compensation will be comprised of 40 percent cash and 60 percent gift cards, or a claimant may choose to receive 100 percent in gift cards.

    I don’t understand. All the claims they made about CoConut Oil are true. Coconut Oil is proven to be one of the best and most healthy things. i will not participate in this false claim and I fully support BetterBody to Continue promoting the huge health benefits of Coconut Oil

    How about their Agave? I am told it was now considered not a good sugar substitute as it is not non glycemic.

      But all those claims are true. I just wrote a huge freakin’ paragraph about the validity of them, but the page refused to load. But suffice it to say, this lawsuit was probably brought by the same food oil companies that villified Coconut Oil generatons ago and convinced people to use fake trans oils, and rancid overprocess corn, bean and mustard seed oil ( canola aka rapeseed)

      Do you own research and see that coconut oil is as healthy if not more than any other NATURAL cooking oil like butter or olive oil. Maybe you are not allowed to say anything is healthy. Coconut Oil is 30% Medium Chain Triglicerides which are absorbed directly via the portal vein to the liver and is used as quickly as carbohydrates for energy. Any simple search for a research paper can show that. Plant oils DO NOT CONTAIN cholesterol. That is a DUH observation, so why can’t they say that on their package. Coconut oil may be satruated fat but it does not nor has it ever contained cholesterol. I’ve never bought this brand, but I feel sorry for them trying to let people know that coconut oil is not something to be feared. ( unless you are allergic to coconuts)
