Details: The Bank of America overdraft fee settlement will resolve a class action lawsuit, entitled In re: Checking Account Overdraft Litigation, that accuses Bank of America and nearly 30 other banks of manipulating debit transactions to maximize the fees they could charge customers who overdrew their bank accounts. Bank of America denies any wrongdoing, but has agreed to settle its part in the case by creating a $410 million settlement fund to reimburse Class Members.
You’re considered a Class Member of the Bank of America overdraft fee class action settlement if you had a Bank of America checking account and/or savings account that you could access with a BofA debit card, anytime between January 1, 2001 and May 24, 2011, and you were charged one or more overdraft fees as a result of Bank of America’s practice of posting debit card transactions from highest to lowest dollar amount.
As part of the Bank of America overdraft settlement, Class Members will receive payments or account credits for the unlawful overdraft fees they paid. The amount of such payments or account credits cannot be determined at this time, but will be based on the number of people in the Settlement Class and the amount of additional overdraft fees each Settlement Class Member paid as a result of Bank of America’s posting order.
If you are included in the Settlement Class and entitled to receive a cash benefit, you do not need to do anything to receive a payment or account credit from the BofA overdraft settlement. If you Court approves the Settlement and it becomes final and effective, you will automatically receive a payment or account credit.
However, if you wish to opt-out of the Bank of America settlement and retain your right to sue individually, you have until October 3, 2011 to submit your request for exclusion.

hey I received mail in 2011-2012 about this law suite I am totally a big part of this since bank of america screwed me over big time, I was told I would receive a payment and its now 2014 and have not received anything I want to know why and how I get my payment and my credit fixed thanks to this fraudulent company please get back to me asap thanks
It’s illegal for a person to rob a bank but evidently it’s perfectly legal for a bank to rob a person! Go figure.
Sounds like most of you got much more then we did. How about $1.45?? Guess it all depends on the amount you got charged? Was not worth my time, but I’m sure that the consulting company will have a good holiday.
Sky, was this $74 from the settlement that was just reached? I thought we were sappose to get like $5000 per plaintiff?
This is crap! I know I’ve paid more than 2 overdraft fees during that time frame and got a mere $74 back!!! That’s only 2 of the fees!!! Just goes to show that BofA screwed way too many people over and had to reimburse too many of us!
Yes i’m like many of you waiting for Bank Of America to pay up. But so far all i got was a post card, i hope my name is still in the books as part of this so called class action lawsuit right.
i also, had a bad experience with BOA. i had opened an account with them, i had direct deposit, every pay period, they would take an overdraft fee which came to 70. 00 every two weeks. i called them numerous of times, on this matter, and they claimed, they were going to reimburse me, well, nothing was done my funds kept coming up short, i would be sent 936.00 from my job, by the time i recieved my check i was collecting 856.00 due to overdraft fees, so i stopped my direct deposit, came out owing them 89.00, bull s@#t, not gonna happen captain, til they pay me my funds, or maybe not cuz yhey caused me hardship, icouldnt pay my bills, i started getting shut off notices.
Per Lundens comment that she can not open an account because of BofA there are plenty of second chance banks that will open an account for you. Use google you will find plenty!
bank of america ripped me off for close to 8000 dollar for 10years and they had the nerve to call me last month saying i closed my acct -150 well bank of america kiss my butt im giving you a red cent.
Watch out for their ATM machine. I deposited a check for roughly 30K into tmy account via ATM. There was a problem with the signature on the check and they supposedly sent it back to me. So far (it has been 3 weeks) no one seems to know where the check is or how they would even go about tracking the check.
This is the most stressful financial experience I have had in years and Bank of America doesn’t know how to fix it. Once the mess is straightened out, I am removing all my money and changing my mortgage company over to a more organized institution.
