Bank of America agreed to settle a class action lawsuit that accused the financial giant of unfairly collecting overdraft fees on debit card transactions.
Lead plaintiff Sherry L. Bodnar claimed that Bank of America charged overdraft fees to customers through assessments of their accounts that actually contained enough money to pay for the transaction.
The settlement agreement was reached after extensive negotiations between both parties. Under the terms, Bank of America will set aside $27.5 million for consumers who were charged an overdraft fee when their account had enough funds to cover the transaction.
Class Members will automatically receive benefits from this settlement unless they opt out no later than June 6, 2016.
Who’s Eligible
Bank of America settlement Class Members include all individuals in the U.S. who had a BofA consumer checking account and were charged an overdraft fee between May 25, 2011 and Feb. 5, 2016 on transactions that were authorized and approved when sufficient funds were available to cover the amount.
Potential Award
Varies.
The Bank of America class action settlement fund of $27.5 million will be divided with all Class Members based on the amount of overdraft fees each individual paid.
Proof of Purchase
N/A
Class Members don’t have to file a Claim Form or provide a Proof of Purchase, they will automatically receive a payment or account credit if the court approves the settlement at the final hearing.

UPDATE 3: On September 7, 2016, the appeals were dismissed. Per the settlement website, account holders were issued credits on September 19, 2016. I received a check for 5.00 for o the more than 1,000 dollars in over fees.
I too was notified about the class action suit , unfortunately I have heard or seen anything either.Would like to know what’s going on?
I sent a reply based on Bank of America extended overdraft fees that was charged to my account in the past And they were numerous amounts of them. Somehow or another they were typos in that reply so I’m sending a second one and thank you if you respond. I have been following the Bank of America extended over to have class action lawsuit and I see that the what the settlement and they were an appeal however is says if I never received a check for a credit to my account or my banking account checking account to let you know. So now I’d appreciate it if some will respond to me Based on the fact that I am still in title to one who have not received it yet for if I mean title to any reward based on the Bank of America extended overdraft fee class action lawsuit Thank you
I never received any award payment or was my checking account debit or credit for any reason based on this Bank of America class action lawsuit in which I was charged numerous I mean you miss the mouth of overdraft fees. ID receive notification mail that I would be included based on those facts. Please respond to me because Mono into this for a couple of years now in the mission something about appeals and the appeals with thrown out please respond to this message and let me know if I’m still entitled to anything because I have never ever received anything in the mail
Stephen Crowley have been a Bank of America checking account customer since 2013 to present. This bank has charged me 35.00 on several occassions for overdraft fees. And then another 35.00 if I had not paid it within 5 days. Thats 70.00dollars
Bank of america has repeatedly charged me overdraft fees. And even offer ? from your account with a.0 balance. For a 35.00 fee
My account was closed over 3 years ago staying I owed over 600 in overdraft fees!
I never recieved any refund from them either. Im exspecially concerned about the extended overdraft fees! Last one I recieved was 10/2018
But I would like to be refunded all the extended fees. .they have charged me. One time $105.00 for $2.50 fee charge they decided to conveniently charge me even though the atm used was aweek and a half before fee?
I filled out a class action suite.. Don’t know what happened. But I think its sickning that they ( the bank) are bragging 98% profit off our loses.. Its as bad if not worse then payday scams fees..its our banks were supposed to be able to trust them. What happened? When did it just become a money grubbing, making, business?
I never got any checks myself! there they’ve been charging me overdraft fees for the last three years at least $300 a month. They never sent me a postcard or anything. I’ve been banking with them for years.
