Details: The Bank of America overdraft fee settlement will resolve a class action lawsuit, entitled In re: Checking Account Overdraft Litigation, that accuses Bank of America and nearly 30 other banks of manipulating debit transactions to maximize the fees they could charge customers who overdrew their bank accounts. Bank of America denies any wrongdoing, but has agreed to settle its part in the case by creating a $410 million settlement fund to reimburse Class Members.

You’re considered a Class Member of the Bank of America overdraft fee class action settlement if you had a Bank of America checking account and/or savings account that you could access with a BofA debit card, anytime between January 1, 2001 and May 24, 2011, and you were charged one or more overdraft fees as a result of Bank of America’s practice of posting debit card transactions from highest to lowest dollar amount.

As part of the Bank of America overdraft settlement, Class Members will receive payments or account credits for the unlawful overdraft fees they paid. The amount of such payments or account credits cannot be determined at this time, but will be based on the number of people in the Settlement Class and the amount of additional overdraft fees each Settlement Class Member paid as a result of Bank of America’s posting order.

If you are included in the Settlement Class and entitled to receive a cash benefit, you do not need to do anything to receive a payment or account credit from the BofA overdraft settlement. If you Court approves the Settlement and it becomes final and effective, you will automatically receive a payment or account credit.

However, if you wish to opt-out of the Bank of America settlement and retain your right to sue individually, you have until October 3, 2011 to submit your request for exclusion.

    If you read EVERYTHING, you will see that although a settlement has been reached nothing will happen until after an appeals, so this could take a couple of more years.

    This notice gives a number to call ((800) 372-2390) to get automated updates. A settlement was reached and approved; however, nothing has been paid to BOA’s customers as of 12/16/11 because a member of the class action suit has decided to appeal the settlement approval. That basically means no money will be doled out until Appellate Court hears case or appeal is settled. This could take 1-2 more years according to the recording.

    yes i would like to have that number too, from 2001 -2010 , i too was dealt with un-fair. i am so sure that i payed over 2000.00 in overdraft fees.

    I do not think it is fair that I did not receive anything at all! After having to pay Bank Of America I was told that my name would be cleared up after they realized it was something their employees messed up on but now years later I still cannot get a bank account because noone will approve me because Bank of america still has not cleared my name up!!! THEY ARE THE BIGGEST SCAM I HAVE EVER DEALT WITH AND I WANT ANSWERS NOW!!!! PLEASE HELP!

    About 2 years ago someone had got a hold of my account number I went into the Clovis NM branch and had them turn that account off and open a new account. I signed papers saying this was done. I would deposit my checks into the “new” account (or so i thought) then I started receiving checks being sent back due to no funds, I was able to use my debit card with no money in there! I then found out that the bank of america employee did not turn off the old account and when I was depositing money into my “new” account they were really putting it in the account that was supposed to be closed. I ended up having to pay bank of america a little under $400.00!!!! I had to pay business’s returned check fee’s, and the amount the check was written. I would say I have paid approximatelly $800.00 out of pocket DUE TO THEIR MISTAKE!!!

    Does anyone have any information about who I can contact directly to speak with someone about the law suit? I paid a ton of money to bank of america in overdraft fee’s and I did not receive anything from the lawsuit!!!

    My Name is Toni Burks . I had got married and added my new Husband George Hollinger to my acount he had Dirrect Deposit . bank america would over draft our account and would take his hold check. my husband went to the plano branch several time to make a complaint but they would say that it was right but it continued over months doing the samething so my husband spoke with his employer about it and took him off dirrect deposit and left the bank.. also when the crisis started I had a credit card where I put my own 500.00 dollars on I got the card to try to fix my credit was paying every month on time all of a sutton they changed my bill date without notice and charged a big fee so I let it go . but this was my own $500.00 dollars that I put on the card to spend but they up the credit rates very high afterwards bank of america is a scam. and don’t mine scamming their customers for there own profit
