Consumers who purchased Babyganics baby care products may be entitled to cash from a $2.215 million paid out by the maker, KAS Direct LLC, as a part of a Babyganics class action settlement over alleged false advertising.

The Babyganics false advertising settlement will end allegations that KAS Direct misleadingly marketed its products as organic and made from “mineral-based” ingredients.” Products included in the my Babyganics settlement include: Babyganics brand lotions, toothpaste, shampoo, diaper rash cream, and sunscreen.

The Babyganics skincare lawsuit alleged that consumers purchased Babyganics products based on advertising touting the products as organic.

Under the terms of the Babyganics class action settlement, Class Members will be entitled to either a full refund with proof of purchase or partial reimbursement without proof of purchase for up to eight Babyganics items.

The Babyganics false advertising settlement also requires KAS Direct to update Babyganics products packaging and advertising to help consumers understand whether the ingredients in the product are organic.

KAS Direct admits no wrongdoing under the terms of the Babyganics false advertising settlement agreement.

Class Members can object or exclude themselves from the Babyganics class action settlement by Oct. 10, 2018.

Who’s Eligible

The my Babyganics settlement Class Members include those in the United States who purchased certain Babyganics organic products starting Sept. 7, 2010 until June 26, 2018 for personal use.

Potential Award

Varies. Class Members with proof of purchase will receive a full refund. Class Members without proof of purchase will receive a partial refund of up to eight covered Babyganics products.

Proof of Purchase

For a full refund, proof of purchase must be submitted, including a receipt or “other document reflecting a purchase of a specific Covered Product during the Class Period.”

    Check received today ($165.91) I had valid receipts for everything. It doesn’t amount to a full refund according to my receipts ($250+) but it’s still much better than the tiny check I received from the Honest Co. settlement.

    This I sent getting ridiculous! Are they hoping we all forget or something!? Seems like they’re stalling so they don’t have to pay!

      Oh, they are most definitely stalling. I received this message on Tuesday, even though I’ve provided a proof of purchase with my initial claim. See below:

      “Your claim is Deficient because you provided insufficient supporting documentation.

      We received your Claim Form in the Babyganics Settlement. Your Claim Form and supporting documentation have been reviewed. It was determined that

      1 products that you submitted are properly documented 4 products that you submitted are insufficiently documented 0 products that you submitted are not documented

      If you wish to cure this deficiency, you must provide supporting documentation for all of the purchases you claimed. If you do not provide supporting documentation for all eligible products, your claim will be reduced to the number of products that you properly documented (1) and any additional undocumented products up to a maximum of eight (8) undocumented products.

      Some examples of supporting documentation are: (a) a receipt that includes “Detailed Purchase Information” (i.e. purchase date, product name, purchase price, and quantity purchased), (b) an itemized invoice with Detailed Purchase Information, (c) other documentation that establishes Detailed Purchase Information. Supporting documentation showing only a delivery date and an order code, or a credit card statement with a total dollar purchase is not sufficient. Supporting documentation must include the name of the eligible product, the individual purchase price and the purchase date.

        I did not respond back to the email, the discrepancy was but maybe 1 or 2 items. Still i had receipts and all, but I figured anything back at this point was a miracle.
        No check received yet, but at least I know they received my claim.

    Does anyone know the email address for class counsel? I’d suggest emailing them and copying the settlement administrator on all emails to make sure they know what’s going on with how late the settlement payments are. This is ridiculous.

    If anyone has the emails for class counsel, please post them!

      This definitely seems way over the 90 days from the effective date to disburse settlement benefits. All I could find regarding class counsel on the FAQs page is below. I have emailed to ask about claim updates and gotten replies via this email: info@babyganicssettlement.com. Good luck!

The Court has appointed these lawyers and firms as “Class Counsel,” meaning that they were appointed to represent all Settlement Class Members: Clayton Halunen and Amy Boyle of Halunen Law; Charles Joseph LaDuca and Katherine Van Dyck of Cuneo Gilbert & LaDuca, LLP; and Jason Sultzer of The Sultzer Law Group PC.

      You will not be charged for these lawyers. If you want to be represented by your own lawyer, you may hire one at your own expense.
