Amazon has agreed to give customers 12 million free audiobooks to resolve an Audible membership credit class action lawsuit.
There are three Classes eligible for payment under the settlement. The payment card Class includes Audible customers were charged on a card other than the card originally designated as the primary payment card for their membership between March 10, 2013 and Aug. 17, 2018.
The regular member Class includes Audible customers who lost unredeemed paid membership credits between March 10, 2013 and Aug. 17, 2018.
Gift Class Members include Audible customers who bought or redeemed an Audible gift membership between Aug. 11, 2011 and Aug. 17, 2018, that resulted in credits being lost.
When each month of Audible services is renewed through subscription, customers receive one “credit” that they can use to redeem an audiobook.
However, when a customer previously cancelled their membership with Audible, they were allegedly forced to give up the credits they had paid for through their membership.
The Audible class action lawsuit was filed by several plaintiffs in March 2017 and included claims that Audible wrongfully cheating their customers out of credits paid for as a part of their membership.
The plaintiffs also argued that Amazon charged cards for the service that were not authorized to be used for Audible subscription payment.
Amazon and Audible reached a settlement with the plaintiffs in March 2019. The massive online retailer and its subunit do not admit any wrongdoing by settling the claims and instead seek a resolution for all parties.
Under the settlement, Class Members are not required to submit a claim in order to participate.
These individuals should receive an initial email informing them of the settlement. If the settlement is granted approval at the final approval hearing (July 8, 2019), Class Members will receive an email to claim their settlement award.
If Class Members take issue with the settlement, they can object to the agreement or exclude themselves from the settlement by May 23, 2019.
Who’s Eligible
Payment Card Class: Audible customers who incurred charged from the company to a card other than the card originally designated as the primary payment card for their membership between March 10, 2013 and Aug. 17, 2018.
Regular Member Class: Audible customers who lost unredeemed paid membership credits between March 10, 2013 and Aug. 17, 2018.
Gift Class Member: Audible customers who bought or redeemed an Audible gift membership between Aug. 11, 2011 and Aug. 17, 2018, that resulted in credits being lost.
Potential Award
Payment Card Class Members will be offered reimbursement of qualified payment card expenses. All other Class Members will be eligible to receive one free audiobook from an approved list.

Remember: you are submitting your claim under penalty of perjury. You are also harming other eligible Class Members by submitting a fraudulent claim.
