Victim of Tennessee Tractor Trailer Accident Launches LawsuitThe victim in a tractor trailer accident in Tennessee has launched a lawsuit against the driver of the opposing vehicle and his employers, aiming to hold them accountable for his injuries.

Plaintiff Tres A. says that he was driving a 2002 Nissan automobile on Aug. 1, 2017, traveling Westward in Marion County, Tenn. when Eugeniusz M., operating a 2006 Volvo tractor-trailer and traveling the same direction, pulled off to the shoulder of the road, then pulled back onto the road and attempted to pull an illegal U-turn. Tres says that in making the illegal U-turn Eugeniusz hit Tres’ vehicle and injured him in a hard and violent collision.

Tres also states that the truck was owned by Eugeniusz’s employers R. Bruce Carroll and the RFS Group, Inc., and that Eugeniusz used the vehicle both for business and personal uses. In the Tennessee tractor trailer accident lawsuit, Tres aims to hold Eugeniusz, R. Bruce Carroll, and RFS Group Inc. liable for his injuries.

Tres alleges that Eugeniusz’s negligence in his driving caused the collision. Tres accuses the driver of the following:

  • failing to keep a proper look out ahead;
  • failing to operate the vehicle as a reasonable and prudent person would under existing traffic conditions;
  • failing to keep the vehicle under proper control; and
  • making turning movements in violation of Tennessee law

Tres argues that not only Eugeniusz, but Eugeniusz’s employers who owned the vehicle involved in the crash, should be held liable. The tractor trailer lawsuit points out that Tennessee law dictates that, in some circumstances, the owner of the vehicle can be held responsible if their vehicle is involved in a collision.

The tractor trailer collision lawsuit says that Tres was injured in the crash and had to undergo numerous medical procedures to recover from the collisions. Tres says that he incurred medical costs and lost wages due to missed work and decreased earning capacity because of the injuries he suffered in the collision, including over $12,000 in medical bills for the treatment of his injuries.

He claims that he experienced pain and suffering, as well as a loss of enjoyment of his life because of the injuries he suffered. Tres says that injuries will be long-lasting and costly.
