Anthem Inc. and other health benefit companies have agreed to pay $115 million to settle a class action lawsuit stemming from a data breach announced by Anthem in February 2015.
If you received a notice from Anthem about the data breach or if your personal information was taken during the Anthem data breach, you may be entitled to benefits from the class action settlement.
In February 2015, Anthem announced that a cyberattack resulted in the theft of information stored in its databases. The information from about 79 million people was reportedly stolen, and possibly included their names, dates of birth, Social Security numbers, health care ID numbers, home addresses, email addresses and employment information.
The Anthem data breach class action lawsuit accused Anthem and the other defendants of failing to adequately safeguard consumers’ personal information. The defendants include Anthem, its subsidiaries and affiliates, and certain Blue Cross and Blue Shield companies who had members with data stored on Anthem’s databases that was compromised due to the Anthem data breach.
The defendants deny any wrongdoing but agreed to settle the Anthem data breach class action lawsuit to avoid the burden and expense of ongoing litigation.
According to the Anthem data breach class action settlement documents, Anthem has agreed to change its business practices in order to improve the security of customers’ personal information stored on its databases.
Anthem will also establish a $115 million fund to provide payment for out-of-pocket losses Class Members suffered or credit monitoring services to protect Class Members from future harm.
Class Members who would like to opt out of or object to the Anthem data breach settlement must do so no later than Dec. 29, 2017.
Who’s Eligible
You are a Class Member of the Anthem data breach settlement if you received a notice from Anthem about the data breach that was announced in February 2015, or your personal information was taken during the Anthem data breach and is included on Anthem’s Member Impact Database.
Potential Award
Up to $10,000 in out-of-pocket losses or up to $36 for Class Members who already have a credit monitoring service they plan to keep for at least one year.
The Anthem data breach class action settlement provides the following benefits to eligible Class Members:
- Free credit monitoring services (or up to $36 cash for Class Members who use a different credit monitoring service for at least a year)
- Free fraud resolution services
- Cash reimbursement for out-of-pocket expenses (up to $10,000)
Out-of-pocket losses that are eligible for reimbursement include the following costs incurred after January 2015:
- Costs of credit monitoring or identity protection services you obtained
- Unreimbursed losses, fees or charges incurred as a result of identity theft or fraud connected with the possible misuse of your personal information
- Professional fees and other costs incurred while addressing identity theft or fraud
- Costs associated with credit freezes
- Notary, fax, postage, copying, mileage, and long-distance charges that you can show were incurred in connection with identity theft or fraud
- Reimbursement of the time spent remedying issues related to the Anthem data breach (calculated at a rate of $15 per hour for up to 10 hours, or time off work at your documented hourly wage, whichever is greater)
NOTE: Out-of-pocket costs claims that are received after $15 million has already been claimed will be denied.

I show something in my Informed Delivery coming today…according to my phone call a few days ago, it should be a check.
Just checked the mail and got mine. I must say it was a very generous amount but, won’t give exact amount. It took over 2 years and I had to send in a lot of proof to get what I got. Good timing for the holidays…Thanks KCC! : )

I know it said up to $36 but I just got my email 10 mins ago and to my disbelief the check is for $441.11. Thank God!
The last time checks were mailed was september. Whoever is answering the phone said that there weren’t any mailed in October due to some delay. Checks were supposed to be printed 11/16 and should be in the mail Monday 11/18. He said that anyone who calls on Monday can find out whether they have a check, deficiency, or denial in the mail. All submitted claims have already been looked at and have had some kind of decision made on them.
You were correct. I just called and was told my claim was approved and my check went out in the batch yesterday. The rep could not tell me an amount though but, that it definitely went out and I should be receiving it sometime this week or next. However, the rep said it could take up to 12/6/19 because, of the Thanksgiving holiday next week but, I got a feeling we will start seeing checks before then. Like the person said above you can call now and they will let you know the status if a check went out yesterday or a denial letter or deficiency letter. I received (2) deficiency letters in the past but, got everything they ask for to them and FINALLY got approved! Best of luck Everyone. : ) The # is: 1-877-703-0745.
What kind of stuff did your deficiency ask for? Apparently I am getting one but they couldn’t tell me what it would say. I submitted a copy of every page of the police report but I guess that wasn’t enough.
Yeah, they asked for a lot of documentation even after I initially had given them lots of proof. My 1st deficiency letter asked for a police report during that time period so, I had to go to the police station to retrieve it then my 2nd deficiency letter asked for a copy of my insurance card from BCBS during that time period. Thank goodness I had the card from years ago in some old paperwork that had not been discarded. I was a little upset though because, I don’t see why all of this wasn’t asked for at the same time. Once I sent in the first thing they asked for they turned around and ask for something else. Had to go through a lot but, finally got approved for my out of pocket expenses. Whew. I got a call yesterday that my check would be sent Nov 16th now but they couldn’t confirm the amount yet. Fingers crossed for Nov 16th, oct 16 was a big let down

I’m assuming that the next round is next week based on the “receive by” date of November 16th. When KCC mails a check, they tell you to wait up 10 business days after mailing to contact them if you haven’t received it. A check would have to go out next week so that 10 days from mailing would be the November 16th. If they aren’t going to meet that deadline then I’d expect the website to be updated next week. They did a pretty good job of providing updating it a few days after the August 16th deadline

Last I heard a couple of weeks ago still no disbursement date. I don’t understand that either my claim was approved in September but not in time for the 9/16 disbursement. Anyone here with a more recent update?

I don’t know the email address but I think that the comments have a security feature in it that don’t allow email addresses to post. The law office is located in New York so try calling tomorrow during regular east coast business hours. They may also not answer the phone during lunch hours. They’ll call you back soon from a 516 number if you leave a message
