Anthem Inc. and other health benefit companies have agreed to pay $115 million to settle a class action lawsuit stemming from a data breach announced by Anthem in February 2015.

If you received a notice from Anthem about the data breach or if your personal information was taken during the Anthem data breach, you may be entitled to benefits from the class action settlement.

In February 2015, Anthem announced that a cyberattack resulted in the theft of information stored in its databases. The information from about 79 million people was reportedly stolen, and possibly included their names, dates of birth, Social Security numbers, health care ID numbers, home addresses, email addresses and employment information.

The Anthem data breach class action lawsuit accused Anthem and the other defendants of failing to adequately safeguard consumers’ personal information. The defendants include Anthem, its subsidiaries and affiliates, and certain Blue Cross and Blue Shield companies who had members with data stored on Anthem’s databases that was compromised due to the Anthem data breach.

The defendants deny any wrongdoing but agreed to settle the Anthem data breach class action lawsuit to avoid the burden and expense of ongoing litigation.

According to the Anthem data breach class action settlement documents, Anthem has agreed to change its business practices in order to improve the security of customers’ personal information stored on its databases.

Anthem will also establish a $115 million fund to provide payment for out-of-pocket losses Class Members suffered or credit monitoring services to protect Class Members from future harm.

Class Members who would like to opt out of or object to the Anthem data breach settlement must do so no later than Dec. 29, 2017.

Who’s Eligible

You are a Class Member of the Anthem data breach settlement if you received a notice from Anthem about the data breach that was announced in February 2015, or your personal information was taken during the Anthem data breach and is included on Anthem’s Member Impact Database.

Potential Award

Up to $10,000 in out-of-pocket losses or up to $36 for Class Members who already have a credit monitoring service they plan to keep for at least one year.

The Anthem data breach class action settlement provides the following benefits to eligible Class Members:

  • Free credit monitoring services (or up to $36 cash for Class Members who use a different credit monitoring service for at least a year)
  • Free fraud resolution services
  • Cash reimbursement for out-of-pocket expenses (up to $10,000)

Out-of-pocket losses that are eligible for reimbursement include the following costs incurred after January 2015:

  • Costs of credit monitoring or identity protection services you obtained
  • Unreimbursed losses, fees or charges incurred as a result of identity theft or fraud connected with the possible misuse of your personal information
  • Professional fees and other costs incurred while addressing identity theft or fraud
  • Costs associated with credit freezes
  • Notary, fax, postage, copying, mileage, and long-distance charges that you can show were incurred in connection with identity theft or fraud
  • Reimbursement of the time spent remedying issues related to the Anthem data breach (calculated at a rate of $15 per hour for up to 10 hours, or time off work at your documented hourly wage, whichever is greater)

NOTE: Out-of-pocket costs claims that are received after $15 million has already been claimed will be denied.

    What a scam, I received the post card today. I entered all the information to file the claim, but on the line where I’m supposed to enter my birthdate, the field will accept no characters. Of course it is a required field and so I can’t submit the form. No phone number to call for help, no link to email problems. Can’t help but wonder if it was purposefully designed to not work so people couldn’t file a claim. Maybe one of the Plaintiff Attorney’s will read this and bring it up with the Court.

    Like few class notes stated, this goes back a few years. I did not receive a postcard or notification about this breach. When I tried to put in my claim ID # it would only take the first 3 alpha letters and the next 9 numeric numbers. The statement comes back “invalid claim Claim ID #”. What is wrong with your data collection system? As with all data breaches with Credit Monitoring companies, it is a joke.

    My grand daughter is 10 years old and we received a card with her name on it concerning this breach. How do we protect her now and in the future.
    Also how can we check the database to see if she is listed there???

    This is going back 2-3 years ago (maybe more). I don’t recall receiving anything but that doesn’t mean my information was not breached. I have Blue Cross in Florida.
