Current and former Anthem 401(k) plan participants and beneficiaries have secured a $23.65 million class action settlement agreement ending claims that the company charged excessive fees.

Class Members include those who participated in or are a beneficiary of an Anthem 401(k) plan, previously known as the WellPoint 401(k) Retirement Savings Plan, between Dec. 29, 2009 and March 31, 2019. Class Members must have maintained a balance of greater than $1,000 during the Class period or invested in the Vanguard Money Market Fund.

Lead plaintiffs accused ATH Holding Co. LLC, an Anthem subsidiary, of charging them and other plan participants exorbitant fees. According to the Anthem 401(k) class action lawsuit, plan participants were also not provided inexpensive investment options — allegedly a violation of the Employee Retirement Income Security Act, also known as ERISA.

ERISA is a federal law that requires companies that offer certain types of retirement and pension plans, as well as insurance plans, to meet certain standards concerning investment options, fees, and recordkeeping. The law also requires financial institutions to put the best interests of plan participants first.

The Anthem 401(k) class action lawsuit claimed that, in addition to charging excessive fees, plan participants who were interested in capital preservation only had one investment option, the Vanguard Prime Money Market Fund, which was far more expensive than other options not available.

ATH Holding Co. agreed to pay $23.65 million to end the Anthem 401(k) class action lawsuit. Under the terms of the settlement, Class Members with active accounts between Dec. 29, 2009 and March 31, 2019 with an account balance above $0 will automatically be allocated an award into their account. Those with an account balance of $0 or lower will automatically receive a check in the mail.

Former participants in Anthem’s 401(k) plan will need to submit a Claim Form by Aug. 26, 2019.

Each Class Members award will depend on the Anthem 401(k) plan they participated in. There are approximately 120,000 Class Members, according to the settlement notice.

Class Members who wish to opt out or object to the Anthem 401(k) class action settlement must do so by Aug. 5, 2019.

Who’s Eligible

Class Members include those who participated in or were a beneficiary of an Anthem 401(k), previously the WellPoint 401(k), retirement plan between Dec. 29, 2009 and March 31, 2019. Class Members must have maintained a balance of greater than $1,000 during the Class period or invested in the Vanguard Money Market Fund.

Current Anthem participants will be automatically entered into the settlement. Former participants will need to submit a valid Claim Form.

      You can call and ask… they will tell you. I worked there for 15 years until 2014, I got forms and sent them back. Was then told I don’t get anything cause the amount is under $5. They sent forms out to everyone even if you didn’t qualify.

    So current employees and people who still have 401k’s with vanguard have already gotten their money. They got it in Early January.
    I have 2 siblings who still work there and they got theirs already. Also I looked it up on Facebook and there is a group called former WellPoint/NGS associates and everyone is saying they got it already. One person got $17, another got $300. They are taking care of current participants first.

    I emailed the Attorney’s office last week to inquire about the time frame for receiving our disbursements. I received a replay from a paralegal from that office and her reply was we will receive our checks in early 2020. In the email, she wrote that they have from 3 to 6 months after the case closes to process the checks. I believe the agreement was reached on or around 09/04/2019. From that calculation, we should receive our checks by 03/04/2020.

      I am a former employee of WellPoint and would like to know if I am getting any money from this I was employed for 25 years retired in 2015 and did return a claim form

      I called in to ask about mine since I worked for anthem for 15 years until 2014. I was told my amount was under $5 so I would be paid nothing. My husband worked there till 2015 and was told the same thing. I guess it al depends where your money was invested. They shouldn’t have sent everyone forms if they weren’t even eligible! So don’t get your hopes up people! If you call in they will tell you.

    My claim paperwork was mailed before the deadline, I have yet to receive any reponse regarding the payout date. I heard the beginning of 2020.
