XCEL premium motor oil - DG Auto - class action lawsuit no proof

Dollar General Corp. and other defendants have agreed to a $28.5 million settlement to benefit consumers who purchased DG Auto motor oils.

The Class includes anyone living in the United States who purchased any of the following DG Auto motor oils for personal use, not for resale, between Sept. 1, 2010, and Dec. 31, 2017:

  • DG SAE 10W-30 (SF specification) for use in vehicles manufactured after 1988
  • DG SAE 10W-40 (SF specification) for use in vehicles manufactured after 1988
  • DG SAE 30 (SA specification) for use in vehicles manufactured after 1930

Class Members submitting a valid claim form will be able to claim up to $16.80 without proof of purchase.

A class action lawsuit had alleged the defendants deceptively marketed and sold DG Auto motor oils that were obsolete and could potentially harm vehicles.

Class Members may claim refund benefits as well as property damage benefits.

Class Members may make a claim for a full or partial refund, depending on whether they have proof of purchase.

Those who submit a valid claim form for a partial refund without proof of purchase may claim $1.68 per quart for up to 10 quarts of DG Auto motor oil purchased, for a maximum of $16.80.

Partial refund claims are limited to one per household.

Class Members who are able to submit proof of purchase may submit a claim for a full refund, and may claim the actual amount they paid for DG Auto motor oil.

Consumers may not file claims for both partial and full refunds.

Those wanting to submit a claim for property damage allegedly caused by the covered DG Auto motor oils must file a claim form along with supporting documentation.

If the claim is submitted with an affidavit from an ASE-certified mechanic, the Class Member will be eligible for the following cash payments, depending on the vehicle’s mileage:

  • Up to $2,250 if the vehicle was model year 2010 or later and had less than 100,000 miles on it at the time the engine damage occurred
  • Up to $1,250 if the vehicle was model year 2000-2009, had between 100,001 and 200,000 miles on it at the time the engine was damaged, or meets one of the criteria of the above but not both
  • Up to $750 if the claim does not meet the criteria of the first two groups but otherwise qualifies

Those who submit a property damage claim without an affidavit from an ASE-certified mechanic will be entitled to the following, depending on the mileage of the vehicle:

  • Up to $500 if the vehicle was model year 2010 or later and had less than 100,000 miles on it at the time the engine was damaged
  • Up to $350 if the vehicle was model year 2000-2009, had between 100,001 and 200,000 miles on it at the time the engine was damaged, or meets one of those criteria but not both
  • Up to $250 if the claim does not meet the criteria of the first two groups but otherwise qualifies

In addition to the monetary relief, Dollar General has agreed to stop selling obsolete DG Auto motor oils and to implement more oversight to the quality and labeling requirements of its automotive products.

A final approval hearing will take place June 22, 2021.

Class Members who would like to exclude themselves from or object to the DG Auto oil settlement must do so by May 10, 2021.

Claims for refund benefits must be submitted by June 8, 2021.

The deadline to file a claim for property damage benefits must be submitted no later than Aug. 23, 2021

Who’s Eligible

Anyone living in the United States who purchased any of the following DG Auto motor oils for personal use, not for resale, between Sept. 1, 2010, and Dec. 31, 2017:

  • DG SAE 10W-30 (SF specification) for use in vehicles manufactured after 1988
  • DG SAE 10W-40 (SF specification) for use in vehicles manufactured after 1988
  • DG SAE 30 (SA specification) for use in vehicles manufactured after 1930
Potential Award

Up to $2,250.

  • Partial refund: Those who submit a valid claim form for a partial refund without proof of purchase may claim $1.68 per quart for up to 10 quarts of DG Auto motor oil purchased, for a maximum of $16.80.

Proof of Purchase
  • Refund claims: Receipt, the original UPC code removed from the bottle with time and date stamped photos of the front and back label of each product taken after the UPC code is removed, or other documentation establishing the fact and date of the product purchase during the Class Period in the United States.
  • Property damage claims:
    • Proof of ownership of the vehicle at the time the Class Member claim it was damaged
    • Repair receipts, estimates, or work orders
    • Affidavit from the mechanic or other person who diagnosed the vehicle’s damage
    • If the vehicle damage was diagnosed by an ASE-certified mechanic, claimants must submit an affidavit that includes the following information:
      • That they personally repaired or diagnosed the damage to the vehicle via a physical inspection at the time the engine damage occurred
      • A statement that no other obvious cause of the damage was identified
      • A narrative explanation as to how they were able to make the diagnosis and how they are able to assert the damage was caused by the use of the DG Auto motor oil rather than by something else
    • If the vehicle damage was diagnosed by someone other than an ASE-certified mechanic, claims must be submitted with an affidavit that includes the following information:
      • A statement that they did not identify any other obvious cause of damage
      • A list of relevant experience supporting their ability to make the diagnosis
      • A narrative explanation as to how they were able to make the diagnosis and how they are able to assert the damage was caused by the use of the DG Auto motor oil rather than by something else

        I called today the guy was rude he was very dismissive and shady as shit …didnt want to help me…gave me the run around….when i asked him to look my name up he said i didnt apply for this class action….and if i did 30 to 60 days for my check….????? He made me sick….i said ok and hung up…
