Pornhub age verification lawsuit overview:

Pornhub and other pornographic sites run by Aylo Global Entertainment Inc. and Aylo USA Inc. fail to implement age verification systems in violation of Texas law, according to a Pornhub lawsuit Texas Attorney General Ken Paxton filed Feb. 26.

Paxton claims Aylo, which was called MindGeek until August 2023, violates a recently-enacted law intended to protect Texas youth from exposure to sexually explicit material.

The Texas law took effect in September and requires websites that publish sexually explicit content to “use reasonable age verification measures to ensure those viewing their pornography are 18 years of age or older” and to warn about the potential harms associated with viewing pornographic material, Paxton’s lawsuit says.

The Pornhub lawsuit suggests that viewing pornographic material may lead to “potential addiction, impaired brain development and function, and other emotional and mental illnesses.”

Pornhub age verification methods are nonexistent and/or ineffective, Texas AG says

Paxton claims that minors who visit Aylo’s pornographic websites are able to view sexual content by simply clicking an “enter” button to verify that they are over the age of 18, or, in some cases, without any attempt at age verification whatsoever.

Sexual content is often displayed next to the “enter” button that asks the website visitor to verify they are over the age of 18, the Pornhub age verification lawsuit says.

“The age verification methods used by the defendants on their websites cannot be said to verify anything at all,” the lawsuit asserts.

Paxton is seeking a civil penalty of up to $1.6 million plus up to $10,000 each day after the Pornhub lawsuit’s filing date. He asked the court to prevent Aylo from showing sexually explicit content to underage users without verifying that they are at least 18 and to require the company to include health warnings on its pornographic website landing pages.

The Pornhub lawsuit also seeks an injunction preventing Aylo from creating new entities or transferring assets without court approval.

An unrelated Pornhub lawsuit filed in 2021 claimed the website enabled and promoted the sexual abuse of minors.
