Google, Adam & Eve class action lawsuit overview: 

  • Who: A woman going by the pseudonym Jane Doe filed a class action lawsuit against PHE Inc. and Google LLC. 
  • Why: Doe argues PHE, the operator of the website for adult product company Adam & Eve, sends the private and protected sexual information of its website visitors to Google without consent. 
  • Where: The class action lawsuit was filed in the Superior Court of the State of California, County of Los Angeles.

Adult product company Adam & Eve unlawfully discloses the private and protected sexual information of its website users with Google, a new class action lawsuit alleges. 

A plaintiff going by the pseudonym Jane Doe claims Adam & Eve operator PHE Inc. disclosed her sex toy preferences and other information with Google via its web analytics service without permission. 

“When Plaintiff used Defendant’s Website, information that revealed her Private and Protected Sexual Information and IP address was provided to Google without notifying her and without her consent,” the Adam & Eve class action states. 

Doe wants to represent a California class of individuals who have visited Adam & Eve’s website, navigated its pages, entered search terms on the website and/or made a purchase of an adult product on the website. 

Adam & Eve sends protected sexual information to Google via Google Analytics, says class action 

Doe argues thousands of California residents visit the Adam & Eve website each year, while all the while allegedly having their private and protected sexual information and IP addresses sent to Google through Google Analytics. 

“Simply put, Google can use the information that PHE is disclosing in order to identify a specific consumer’s actions on the Website,” the Adam & Eve class action states. 

Doe claims Adam & Eve and Google are guilty of violating the California Invasion of Privacy Act. She is demanding a jury trial and requesting injunctive relief along with an award of statutory damages for herself and all class members. 

In other recent news involving Google, the company agreed to a settlement late last year that resolved claims it covertly tracked the internet searches of millions of users who were under the impression they were browsing privately by using the Chrome Incognito browser.
