SiriusXM website website class action overview:

SiriusXM violates the law by not making its website accessible to legally blind people using a screen reader, a new class action lawsuit alleges.

Plaintiff Leshawn Young filed the class action lawsuit against SiriusXM Holdings on Oct. 19 in a New York federal court, alleging violations of the Americans With Disabilities Act (ADA).

Young is a visually impaired and legally blind person who requires screen-reading software to read website content using her computer. 

According to the SiriusXM class action, the radio and radio subscription company failed to design, construct, maintain and operate its website, siriusxm.com, so it is fully accessible to and independently usable by herself and other blind or visually impaired people in violation of the ADA.

“Plaintiff seeks a permanent injunction to cause a change in Defendant’s corporate policies, practices and procedures so that Defendant’s website will become and remain accessible to blind and visually impaired consumers,” the SiriusXM lawsuit states.

SiriusXM website has multiple access barriers, lawsuit alleges

According to the class action, the SiriusXM website lacks alt-text, has empty links, links images without alt-text and is full of broken links. This makes it incompatible with the screen reader.

“The access barriers Plaintiff encountered have caused a denial of Plaintiff’s full and equal access in the past, and now deter Plaintiff on a regular basis from accessing the Website,” the SiriusXM class action states.

Young looks to represent all legally blind people in the United States who tried to use the website and were unable to.

She seeks certification of the class action, damages, fees, costs and a jury trial, as well as an order forcing SiriusXM to make its website accessible. 

Meanwhile, a consumer hit SiriusXM Radio with a class action lawsuit alleging Florida residents receive annoying, nuisance sales calls from the company in violation of the law.
