Florida residents are getting annoying, nuisance sales calls from Sirius XM Radio, in violation of the law, a new class action lawsuit alleges.
Plaintiff Lylie Obie filed the class action lawsuit on Oct. 29 in a Florida circuit court, alleging violations of the Florida Telephone Solicitation Act.
She says Sirius XM Radio, a New York-based satellite and online radio company, made unsolicited phone calls to her and others in order to promote its services.
Sirius XM used computer program to illegally autodial plaintiff, class action alleges
Specifically, Obie says on Aug. 4 and Aug. 10, she got pre-recorded telemarketing sales calls from Sirius XM to her mobile phone, asking for payment of satellite radio services.
“[The] plaintiff has never transacted with defendant, has never contacted or been contacted by Defendant and does not have nor ever sought an account with defendant,” the lawsuit states.
Obie says Sirius XM used a computer software system to dial her number, which she never gave permission for, in violation of the law.
As a result, she and others had suffered harm, including violations of their legal rights, annoyance, nuisance and invasion of privacy.
Obie is looking to represent anyone in Florida who got a telephone sales call from Sirius XM using an auto-dialer.
She’s seeking more than $30,000 in damages, plus interest, costs, attorneys fees and a jury trial.
This is not the first time the company has been accused of making improper telephone marketing calls. In 2020, Sirius XM Radio agreed to a class action settlement worth $32.4 million arising from claims that the satellite radio service violated the Telephone Consumer Protection Act.

I’m in California and was getting the unsolicited calls from them. Was getting two calls a day for a week until I finally told them to take me off their list.
