Modshop website class action overview:

Retailer Modshop does not make its website accessible to legally blind consumers who use a screen reader, a new class action lawsuit alleges.

Plaintiff Rafia Lawal filed the class action lawsuit against Spot International Inc (Modshop) Oct. 4 in a New York federal court, alleging violations of the Americans With Disabilities Act (ADA).

Lawal is legally blind and uses a screen reader to browse the internet and interact with companies’ online services.

However, upon visiting Modshop’s website, www.modshop1.com, Lawal quickly discovered the company’s failure to maintain and operate its website in a way to make it fully accessible ftoor herself and other blind or visually-impaired people, she says.

“Plaintiff brings this civil rights action, individually and on behalf of those similarly situated, seeking redress for Defendant’s actions which violate the ADA,” the Modshop class action states

Modshop website has multiple barriers, lawsuit alleges

Lawal visited the website on multiple occasions to browse and make a purchase, she says.

Despite her efforts, Lawal says she was denied access similar to that of a sighted individual due to the website’s lack of accommodations, which effectively barred her from being able to enjoy the “privileges and benefits” of the retailer’s services.

For example, many features on the website fail to accurately describe the contents of graphical images, properly label a title or distinguish one page from another, the Modshop class action states.. The Modshop website also allegedly contains multiple broken links and headings that do not describe the topic or purpose.

“These access barriers effectively denied Plaintiff the ability to use and enjoy Defendant’s website the same way sighted individuals do,” according to the Modshop class action.

Lawal looks to represent all legally blind people in the United States who have attempted to access the Modshop website and have been denied access due to the accessibility barriers.

She seeks certification of the class action, an injunction forcing the company to make its website accessible to those using a screen reader, damages, fees, costs and a jury trial.

In related website news, last month, a consumer hit Overtime Sports with a class action lawsuit alleging its website also is not accessible to blind and visually impaired people using a screen reader.
