Russell Stover fails to make its website fully accessible to legally blind and visually impaired individuals, a new class action alleges.
Plaintiff Ana Chalas claims Russell Stover’s website is not designed in a way that makes it fully compatible with screen-reading software used by the legally blind and visually impaired to browse online.
Chalas claims Russell Stover’s website contains a number of accessibility issues for legally blind and visually impaired individuals that keep the screen-reading software from being able to work properly.
Russell Stover Class Action Says Company Denies ‘Equal Access’ to Website
“The access barriers that Plaintiff encountered have caused a denial of Plaintiff’s full and equal access multiple times in the past and now deter Plaintiff on a regular basis from accessing the Defendant’s website in the future,” the class action states.
The Russell Stover’s website still has accessibility issues to this day, according to the lawsuit.
Chalas claims Russell Stover is in violation of the Americans with Disabilities Act and New York City Human Rights Law.
He wants to represent a nationwide class of legally blind and visually impaired individuals who have been “denied access to the equal enjoyment of goods and/or services” offered on Russell Stover’s website within the last three years.
He also demands a jury trial and requests declaratory and injunctive relief along with statutory, actual, and punitive damages for herself and all class members.
A plaintiff filed a similar class action lawsuit against Mrs. Fields earlier this month over claims the company failed to make its website fully accessible to blind or visually impaired individuals.
