Colgate University failed to design its website so that it would be fully accessible to blind and visually impaired individuals, a new class action lawsuit alleges.
Plaintiff Kimberly Miller, who is blind, claims Colgate is in violation of the Americans with Disabilities Act (ADA) and The Rehabilitation Act of 1973 (RA) by not making its website independently usable for individuals who are blind or visually impaired.
Miller claims Colgate’s website is not compatible with screen-reading software used by blind and visually impaired individuals to browse the internet.
“By failing to make its Website available in a manner compatible with computer screen reader programs, Defendant deprives blind and visually-impaired individuals the benefits of its online goods, content and services,” the Colgate University class action states.
Colgate University Class Action Claims Lack Of Website Accessibility Adds ‘Stigma’
Miller argues that Colgate not making its website as accessible for blind and visually impaired individuals as for the sighted increases “the sense of isolation and stigma among those persons that Title III was meant to redress.”
She demands a jury trial and requests declaratory and injunctive relief along with compensatory, statutory and punitive damages for herself and all class members.
Miller wants to represent a nationwide class and New York subclass of blind and/or visually impaired individuals who were denied “equal enjoyment to goods and services” offered on Colgate’s website.
A similar class action lawsuit was filed last month against Choice Hotels over claims the company did not make its website fully accessible to individuals who are blind.
