Pure Romance Accessibility Class Action Lawsuit Overview: 

  • Who: Yensy Contreras filed a class action lawsuit against Pure Romance, LLC. 
  • Why: Contreras claims Pure Romance’s website is not fully compatible with screen-reading software used by legally blind and visually impaired individuals.

Pure Romance, LLC fails to make its website fully accessible to blind or visually impaired individuals, a new class action lawsuit alleges.

Plaintiff Yensy Contreras claims blind or visually impaired individuals who accessed Pure Romance’s website have been “denied access to the equal enjoyment of goods and/or services offered.” 

Contreras claims Pure Romance, which sells personal care products, has not made its website fully compatible with screen-reading software used by legally blind and visually impaired individuals to browse the internet. 

“Unless websites are designed to be read by screen-reading software, blind and visually-impaired persons are unable to fully access websites, and the information, products, goods and services contained thereon,” the class action lawsuit states. 

Contreras claims the website’s compatibility issues are still present as of her filing of the class action lawsuit. 

Among the alleged issues with the website, Contreras claims her screen reader fails to read Pure Romance’s website’s banner, fails to describe images and fails to read icon links for social media. 

The screen reader also fails to read links in advertisement pop ups and to read the “cart” link after an item is put in it, according to the lawsuit. 

Barriers Prevent Blind, Visually Impaired From Enjoying Internet In Same Way As Sighted Individuals, Plaintiff Claims

There are guidelines established by the World Wide Web Consortium which are meant to ensure websites are equally accessible to individuals with sight issues, according to the class action lawsuit. 

“Non-compliant websites usually contain numerous common access barriers that prevent the blind and visually-impaired from enjoying the Internet in the same way sighted individuals do,” the lawsuit states.

Contreras claims Pure Romance is in violation of the Americans with Disabilities Act and New York City Human Rights Law

Plaintiff is demanding a jury trial and requesting relief in the form of statutory, actual and punitive damages for herself and all class members. 

Contreras wants to represent a nationwide class and New York subclass of blind or visually impaired individuals who were denied equal access to goods and services when visiting Pure Romance’s website.

Contreras filed several similar class action lawsuits last year due to alleged screen-reader compatibility issues, including against Tripadvisor, Johnson & Johnson and the Utah Jazz Team Store
